Project Description:

The Town of Conesus is proposing an extension of the existing hiking trail system located on the NYS Department of Environmental Conservation's Conesus Lake Inlet Wildlife Management Area. The trail system will be a mowed trail and include a 16 feet by 16 feet wildlife observation platform overlooking the south end of Conesus Lake. Up to 300 linear feet of open pile boardwalk may be constructed to cross the wetland for the purpose of accessing the wildlife viewing platform. The Town of Conesus will construct and maintain the trail system under an Adopt a Natural Resources Agreement with the NYS Department of Environmental Conservation. Portions of the trail will be located within the NYS regulated wetland (CO-1) and or adjacent area.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

Tech Park Owner LLC has submitted an Air State Facility application to replace the Title V Facility Permit for its Rochester Technology Park natural gas and oil fired boiler plant, which provides steam for leased buildings at the former Kodak Elmgrove site.

The Title V Facility Permit authorized operation of five boilers able to burn either natural gas or #6 fuel oil, modified to restrict boiler heat input to a maximum of 50 million BTU per hour. The facility was subject to 6 NYCRR Part 201-6, Title V Facility Permits, and Part 227-2 Reasonably Available Control Technology (RACT) for oxides of nitrogen (NOx) due to potential emissions of NOx in excess of 100 tons per year.

Subsequently, Tech Park Owner LLC shut down one of the 5 boilers, which reduced potential NOx emissions using natural gas as a fuel to below the 100 ton per year threshold. Potential NOx emissions using # 6 fuel oil remained above that threshold.

As part of this application, Tech Park Owner seeks to maintain the ability to fire the boilers with either natural gas or #6 fuel oil, but still restrict NOx emissions to below the Title V and Part 227-2 NOx RACT applicability threshold of 100 tons per year by limiting #6 fuel oil use in any 12 consecutive month period.

Additionally, Tech Park Owner seeks to avoid the applicability of 40 CFR 63 Subpart JJJJJJ National Emission Standards for Hazardous Air Pollutants for Industrial, Commercial, and Institutional Boilers Area Sources by limiting #6 fuel oil use to periods of natural gas supply curtailment or interruption only.

In response to the application, the Department has generated a Draft Air State Facility Permit including conditions to restrict emissions to below the Title V and NOx RACT threshold on a 12 month rolling total basis. To verify compliance, Tech Park Owner will be required to maintain records of fuel use and resultant emissions from the facility, to be maintained on site for a minimum of five years, and made available with all supporting data to Department inspectors upon request.
