The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0099295), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

The Vanderburgh Cove Sewer District No. 1 has a design flow of 8,000 gpd. Current treatment includes primary settling, aerated flow equalization, bioClere unit and chlorination. The following changes to the permit are proposed: The Schedule of Compliance has been removed and a Mercury minimization program has been added.

Project Description:

Orange County Terminals, Inc. has requested modification of the Industrial State Pollutant Discharge Elimination System (SPDES) permit for the facility located at 6 Sleepy Hollow Road, in the Town of Deerpark. The existing permit authorizes the discharge of stormwater runoff from the secondary containment area of Petroleum Bulk Storage Tanks to a swale tributary of the Delaware River, via outfall 001. The permittee initiated this modification to change the outfall location of the treated stormwater runoff to allow for direct discharge to the Delaware River, which will be achieved by extending and relocating the stormwater outfall pipe. The Department has made a tentative determination to issue the permit modification and a Draft Permit is on file at the DEC office in New Paltz.

Project Description:

The Department has prepared a Draft permit and made a tentative determination to issue a Title V Permit Renewal for US Army Garrison. The facility is an educational institution and an active Army installation. Since potential emissions from the facility of Sulfur Dioxide, Oxides of Nitrogen (NOx), Carbon Monoxide, Volatile Organic Compounds, and Perchloroethylene are above major source thresholds, as defined by the Federal Clean Air Act, the facility is required to obtain a Title V permit. As identified in the Draft permit, the facility is comprised of 18 emission units. These emission units include various boilers, diesel generators, a dry cleaner, a solvent cleaning tank, a paint booth, a landfill collection system, and gasoline dispensing units.

By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the Draft Permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. Project Description:

The applicant proposes reconstruction of the existing dam (NYS Dam ID 147-2207) which impounds an unnamed tributary of the Little Beaver Kill, NYS Waters Index Number D-70-20-25-9-3, Class B(T). The dam was breached during the June 2006 storm event. The breach will be repaired and improvements made to the spillway, drains, and drawdown system.
