Project Description:

The applicant proposes the construction of an agricultural equipment access lane through NYS freshwater wetland BY-27, its regulated 100 feet adjacent area and Bigelow Creek for the purpose of providing access to fallow agricultural lands that are no longer accessible from the north.The access lane will be approximately 15 feet wide, with approximately 200 feet located within the wetland and approximately 85 feet within the regulated wetland adjacent area. A ford will be constructed to allow equipment to cross Bigelow Creek.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

The Department has received an application from Willow Bend Farm LLC for a 1.64 acre expansion of an existing sand and gravel mine on County Road #7. The current permit authorizes operation in a 14.31 acre life of mine area. The 1.64 acre expansion proposed will increase the life of mine area to 15.95 acres.

Excavation is proposed to remove approximately 54,500 cubic yards of sand and gravel from the 1.64 acre expansion area over the next 5 years. Material will continue to be used primarily for Willow Bend Farm operations at the County Road #7 site, and other Willow Bend Farm locations along County Road #4, for fill and farm roads. The expansion will continue current operations at the site.

Mining is not proposed below the local water table. Proposed final contours show grades that will retain storm water runoff within the mined area. No off site discharge of storm water runoff will be permitted. There are no NY State regulated streams or freshwater wetlands within the Life of Mine area.

No change has been proposed in hours of operation. Final reclamation to agricultural land is proposed, and will include the replacement of stockpiled topsoil and seeding with an approved mixture.

The application is available for review at the Region 8 NYSDEC office, and a copy of the application materials has been sent to the Town of Manchester.
