The applicant proposes to construct an approximately 625 square foot garage on the west side of the existing home at 2171 Bush Road in the Town of Grand Island in the regulated 100 foot adjacent area of New York State regulated wetland BW-3. The garage is proposed to be located in a mowed lawn area and would require only minimal loss of natural vegetation, therefore the water quality of the wetland will be protected. The Department has made a tentative decision to approve this application. As a tentative determination, the Department is seeking public comment prior to making a final decision on permit issuance.

State Environmental Quality Review (SEQR) Determination:
Project is not subject to SEQR because it is a Type II action.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination:
Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
