Project Description:

The applicant proposes to dredge 1500 cubic yards of sediment from a 0.23 acre pond located within the 100 foot adjacent area of Freshwater Wetland M-20 (Class III) and excavate a 0.21 acre expansion of this pond in conjunction with the construction of the Body of Truth Holistic Spa on a 20+ acre parcel. The new expansion area to the pond will be constructed prior to lowering the existing pond and removal of sediments. Sediments will be excavated to an average depth of four feet. The total area of disturbance to the wetland is 0.44 acre; the total area of disturbance to the adjacent area of the wetland is 0.58-acre. The total area of the expanded pond will be 0.62 acre with a net increase of 0.25 acre of wetland. Additional mitigation for proposed disturbance includes vegetative plantings within and bordering the pond.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Rochester Town Planning Board

State Historic Preservation Act (SHPA) Determination:

Based on the information provided in cultural resources survey reports for this project, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. Measures have been undertaken in consultation with OPRHP to avoid or mitigate impacts to registered or eligible resources. These agreed upon measures conclude the SHPA review.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

The applicant proposes the restoration of the stream channel of Bear Gutter Creek (NYS Waters Index #ER-3-P 1063-7), a Class A tributary to Kensico Reservoir, which currently flows through a series of ditches and culverts for 591 linear feet along the perimeter of the site of the former Armonk Bowling Alley. An 811 linear-foot meandering stream channel will be created along with 2.90 acres of forested and emergent wetlands. Additionally, a total of 3.13 acres of open water and wetlands would be enhanced or created on the site. Approximately 151 linear-feet of the current stream channel are proposed to be permanently filled to divert flow into the new channel.

Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
