Project Description:

The applicant proposes construction of four single family homes and auxiliary structures which will impact approximately 1.056 acres of the State regulated 100-foot-wide adjacent area of Freshwater Wetland SC-14. The adjacent area impacts will be mitigated by the planting of trees in a vegetated buffer at the rear of the properties; deed restrictions preserving 9.137 acres of wetland and adjacent area; and the addition of 0.33 acre of non-regulated property to the deed restricted area.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

SEQR Lead Agency: Hanover Town Planning Board

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

The Department has prepared a draft permit (NY-0170003) and made a tentative determination to approve this renewal for an existing discharge of 29,796 gallons per day of treated sanitary wastewater from a septic tank and sand filter system into a tributary of Little Buffalo Creek (class C stream). Bush Gardens Mobile Home Park is located on Three Rod Road between Clinton Street and Bullis Road in the Town of Marilla. As a tentative determination, the Department is seeking public comment prior to making a final decision on permit issuance. A draft permit is available for review.
