Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a Title V Renewal1/Modification 2 for a prison facility on Rikers Island in the East River, near both the boroughs of Queens and the Bronx. A power house operates in a separate structure on the island producing steam to provide heat for the entire island as well as process steam for the laundry. The powerhouse has eight boilers with a capacity of 96 mmBtu/hr each firing natural gas or distillate oil as backup. This modification is to operate a new cogeneration plant under emission unit U00011 consisting of two 7.5 MW Solar Taurus 70-10301S natural gas fired simple cycle gas turbines equipped with duct firing heat recovery steam generators and one 2 MW emergency black start engine generator. The facility will create 17.57 tpy of NOx emission reduction credits (ERCs) and 2.70 of PM 10 ERCs through the future curtailment of existing boiler operations. These future ERCs will be used in a net emission increase analysis to avoid applicability to the requirements of New Source Review Regulation Part 231. This cogeneration unit is also subject to 40 CFR 60 Subpart KKKK - Standards of Performance for Stationary Combusion turbines, and the emergency black start engenerator is subject to 40 CFR 60 Subpart IIII.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. Project Description:

In accordance with 6 NYCRR Part 621, the Department has determined the application for a Section 401 Water Quality Certificate submitted by Verdant Power, LLC to install, operate, monitor, and maintain a three-phase deployment of a field of up to 30 underwater turbine units and associated project components known as the Roosevelt Island Tidal Energy (RITE) Pilot Project is complete. The application was submitted to the Department in association with the Federal Energy Regulatory Commission's (FERC) Hydrokinetic Pilot License process. The federal Clean Water Act requires that the State must certify that the action meets State water quality standards prior to the issuance of a federal license or permit. This project has a total capacity of approximately 1 megawatt, and is located in the East Channel of the East River in New York City. The proposed turbines resemble windmills, and are mounted underwater on open tubular steel triframes that rest on the riverbed. A comprehensive environmental review was conducted pursuant to the FERC license application, and application of State Environmental Quality Review (SEQR) to this project is pre-empted by the Federal Power Act. The Department has prepared a draft permit and has made a tentative determination to issue a Title V Renewal 1, Mod 1, for a gasoline storage facility. The proposal is to install two new gasoline storage tanks to emission unit 2-TANKS and Process GSL. The facility is not subject to New Source Review requirements since the proposed emissions from the project and the contemporaneous period net increase are less than 25 tpy. The two new tanks are subject to the Federal NSPS under 40 CRR 60 Subpart Kb, as well as the MACT requirements under 40 CFR 63, subpart R. The applicant is seeking a facility-wide emission of 25 tons for combination of HAP and 10 tons per individual HAP.
