Project Description:

The proposed action is a 48.6 acre expansion to the life of mine limits to the Lafarge North America, Inc.'s facility known as Lafarge Freedom Gravel Products, currently permitted for 220.9 out of 441 acres owned by the applicant at this location. The expansion acreage includes 12.7 acres immediately north of the current mining area located on the west side of Delevan Elton Road (CR 21) and north of Lime Lake Elton Road (CR 36); and 35.9 acres located to the south of Lime Lake Elton Road. The expansion would allow for continued mining of sand and gravel at this location, extending the life of the mine approximately 6 years. Material from the north expansion area will either be trucked or transported by a conveyor to the existing conveyor system which transports material over Delevan Elton Road to the processing plant. Additional activities in the south area include: Installation of a stormwater basin, with a culvert below Lime Lake Elton Road to transmit water to the north side of this road where it will go to groundwater; and an over the road conveyor to transport materials from the south expansion area over Lime Lake Elton Road to the existing field conveyors, which then carry the material to the processing plant located on the east side of Delevan Elton Road. No other changes to the current mining plan or material processing are proposed. Upon final reclamation, a small seasonally wet area approximately 1.7 acres in size will remain in the south mining area; all other areas will be reclaimed to warm summer grasses with wild lupines established for the introduction of the Karner Blue Butterfly.

Project Description:

The applicant proposes to modify their current permit for the mining of sand and gravel and material processing. The modification involves the expansion of the Waterman Gravel Mine, including mining of land (approximately 8.2 acres) adjacent to the previously approved mining area. In addition, the excavation depth of the entire mining area is proposed to be approximately 67.5 feet below the groundwater table. The modification request also includes the addition of a wash plant to the presently permitted crushing and screening operations. The presently approved agricultural reclamation plan is proposed to be changed from agricultural reuse of the land, to the creation of a lake, with a surface area of approximately 44.2 acres. The project is located on Route 240 (Vaughn Street), in the Town of Concord, New York.

Project Description:

The applicant proposes to excavate areas approximately 30 feet wide, 8 feet deep and ranging from 60 to 240 feet long to inspect, and if necessary, repair sections of pipeline at ten mileposts within New York State Freshwater Wetland BN-1 and its 100 foot regulated adjacent area. The proposed work area is located approximately 100 feet north east of I-290, between Park Club Lane and North Burbank Drive in the Town of Amherst. All work will be performed along the pipeline right-of-way, within permanent easements and all disturbed areas will be seeded and mulched. Proper sedimentation and erosion controls will be utilized to maintain the water quality of the wetland.

The Department has made a tentative determination to approve this application. As a tentative determination, the Department is seeking public comments prior to making a final decision on permit issuance.
