Notice is hereby given pursuant to Article 24 (Freshwater Wetlands Act) of the New York State Environmental Conservation Law and the Freshwater Wetlands Mapping and Classification Regulations (6 NYCRR Part 664) that New York State Department of Environmental Conservation (NYSDEC) proposes to amend Erie County Freshwater Wetland Map 3 of 31 originally filed in 1986. The wetland amendment would consist of adding Wetland TE-45 as a Class 2 wetland to the maps. Maps showing the proposed revisions are available at the clerks' offices in the Town of Amherst and Erie County, as well as at the NYS DEC - Region 9 Office, Buffalo, NY. Written comments on the accuracy of the proposed change to the map may be mailed to the person listed below. All comments received through October 10, 2011 will be considered. Pursuant to 6 NYCRR Part 664, once the announcement of a proposed amendment has been made, no activity subject to regulation under the Freshwater Wetlands Act may be initiated without a permit from NYSDEC within the area that is the subject of the proposal (including the regulated 100-foot adjacent area) until the NYS DEC Commissioner has either amended the map or denied the amendment.

Notice of Acceptance of Draft EIS
Erie County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Waterman Gravel Mine Expansion. The action involves the mining of land (approximately 8.2 acres) adjacent to a previously approved mining area. In addition, the excavation depth of the entire mining area is proposed to be approximately 67.5 feet below the groundwater table. The modification request also includes the addition of a wash plant to the presently permitted crushing and screening operations. The presently approved agricultural reclamation plan is proposed to be changed from agricultural reuse of the land, to the creation of a lake, with a surface area of approximately 44.2 acres. The project is located on Route 240 (Vaughn Street), in the Town of Concord, New York.
