Project Description:

The applicant proposes to fill a portion of Freshwater Wetland MO-14 (Class II) and its 100 foot adjacent area to construct a new 24 foot wide paved access road on a 70‑acre parcel in order to provide safe access to an existing water supply well (Well #28) and municipal water treatment building. Activities proposed within the Freshwater Wetland and adjacent area to construct the 300 linear foot portion of roadway include clearing, removal of debris, filling, construction of retaining walls, guiderails and various drainage improvements, installation of new 10' by 4' open bottom culvert, and paving the new road. The total area of disturbance to the wetland is 0.09 acre; the total area of disturbance to the adjacent area is 0.4 acre. The project is located on the south side of Larkin Drive in the Village of Kiryas Joel.

Pursuant to an Order on Consent issued by the NYSDEC, the applicant is proposing to repair the existing dam located at the southern end of St. Josephs Lake. In order to conduct the required spillway repairs out of standing water, the lake must be lowered by approximately 3 to 4 feet. NYS Freshwater Wetland HA-17 (Class 2) is located on the northern portion of the lake and will be temporarily affected by the drawdown. It is estimated that the spillway repairs and the lake drawdown will take approximately 3 to 4 weeks.

Project Description:

On September 29, 2009 DEC issued a Mined Land Reclamation Permit authorizing the mining and processing of sand and gravel from 26.35 acres of a 39.16 acre site. The previously approved plans required the construction of a 1300 linear foot topsoil berm along the northern Life of Mine boundary, to be constructed from east to west. The first 500 feet of the berm was to be constructed prior to the commencement of full scale mining operations in Phase I of the mining plan and the remaining 800 feet was to be constructed prior to the commencement of mining operations in Phase V. The permittee now proposes to delay commencement of construction of the berm until prior to the start of Phase V, at which time 500 linear feet would be constructed. The remaining 800 foot area is proposed to be constructed prior to the commencement of Phase VI. It is also proposed that the berm be constructed from west to east, and that the orientation of the access road be slightly modified.
