Project Description:
These proposed modifications are based on a July 25, 2011 permit modification request received from the New York City Department of Environmental Protection (NYCDEP). Pursuant to the requirements outlined in Section III, Paragraphs A & B of the First Amended Nitrogen Consent Judgment (FANCJ) Index No. 04-402174 (Superior Court, New York County, J. Feinman) that was entered by the New York County Clerk on June 27, 2011, the NYCDEP was required to request, and the NYSDEC is required to process SPDES permit modifications for the above facility to incorporate the language contained in Appendix I of the FANCJ into these permit.
The draft permit has been modified from the existing SPDES permit in the following ways:
- A new subsection has been added to the Schedule of Compliance section of the draft permit to address the treatment plant upgrades for nitrogen removal as provided in Appendix I of the FANCJ.
- Footnote #1 of section entitled "Jamaica Bay WPCPs (Jamaica, Rockaway, Coney Island, 26th Ward) No-Net Increase Effluent Limits and Monitoring for Nitrogen" has been replaced with the language as provided in Appendix I of the FANCJ.
- Exhibit A - Method for Calculating Performance-Based Combined Nitrogen Interim Effluent Limits for Jamaica Bay WPCPs has been added to the permit section entitled "Jamaica Bay WPCPs (Jamaica, Rockaway, Coney Island, 26th Ward) No-Net Increase Effluent Limits and Monitoring for Nitrogen" as provided in Appendix I of the FANCJ.
- The Department corrected two minors errors in the Appendix I language as follows: a) the Exhibit A, footnote 1 reference to " notes c, d & e" was replaced with "notes 3, 4 & 5" to correspond with the appropriate delineation in the Appendix I language; and b) the outfall number designation of "All" in the new Schedule of Compliance, BNR Upgrades section has been corrected with the appropriate wastewater treatment system discharge outfall numbers for each of the four Jamaica Bay Water Pollution Control Plants.
- The draft permits reflect a change in the Department's word processing software. The draft permits have been converted over to a new program and may look slightly different than the previously issued permits. Additionally, as a result of the strict language in the FANCJ that this modification only incorporate the language contained in Appendix I, there may be some minor formatting errors in the table of contents references or page references. It is the Department's intent to make these corrections as part of the upcoming Environmental Benefit Permit Strategy permit modification process.
