Project Description:

The agency has made a tentative determination to modify an existing permit for the discharge of treated municipal wastewater into the St. Lawrence River from the Village of Cape Vincent Wastewater Treatment plant. The Village will be installing new sanitary sewer lines and constructing new wastewater pump stations in the collection system. A new wastewater treatment plant will be constructed on municipal owned property located on Bay Street in the Village of Cape Vincent, Jefferson County. The construction of the new facilities and modifications to the collection system will result in an expansion of wastewater treatment capabilities to an average flow 0.5 MGD. New effluent limits and frequencies will be enacted with start-up of the new facility. The permit modification also adds requirements to abate sanitary sewer overflows and implement a collection system monitoring and maintenance program. Permits for Excavation and Fill in a Navigable Water, Stream Disturbance and Water Quality Certification will also be issued for the new outfall into the St. Lawrence River.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Cape Vincent Village Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

This Department has received a request to modify a permit and has drafted an Article 19 (Air Pollution Control) of the Environmental Conservation Law, an Air State Facility Permit, at the facility located at Burrstone Energy Center CHP Plant, 1656 Chaplin Ave; New Hartford, NY 13502. This facility will produce electricity, and steam for nearby facilities.

The Department has made a tentative determination to approve the application of Burrstone Energy Center CHP Plant's Air State Facility Permit. This modification allows the replacement of emission control equipment to the two sources 0ENG1 and 0ENG2 and the installation of emission control equipment to the source 0ENG3 of emission unit 0-00001, which includes the operation of four internal combustion engines connected to electric generators to produce electricity for St. Luke's Hospital, St. Luke's Home, and Utica College. The operation also includes four heat recovery units that utilize the heat from the engine exhaust to produce steam for heating and other requirements at the facilities. The modification also include the inclusion of requirements of EPA Regulation 40 CFR 63 subpart ZZZZ for Reciprocating Internal Combustion Engines. The compliance date for this facility is October 12, 2013 since this facility is classified as an area source. The facility has capped out of Title V Permitting requirements by tracking and restricting it's emissions of Carbon Monoxide to below emission levels of 100 tons per year, and formaldehyde to levels below 10 tons per year.

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
