Project Description:

The Department has made a tentative determination to approve this SPDES permit application for the discharge from an on-site wastewater treatment system to groundwater. This proposal consists of a 71 home manufactured housing development in Rock Oak Estates in the Town of Clarence. The proposed septic system may serve as many as 83 homes in the future. The permit would authorize the discharge of up to 16,600 gallons per day of sanitary wastewater after treatment by a modified absorption bed system similar to the existing system serving the manufactured homes in the Rock Oak Estates development. The property is located just west of and adjacent to the existing Rock Oak Estates West community on Main Street near the intersection of Kraus Road. The Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought.

Project Description:

The Department has received a request from Life Technologies to modify their SPDES wastewater discharge permit. The facility is expanding operations which will result in an increase in the amount of wastewater generated. The facility has made improvements to the treatment system to provide increased detention time, better aeration, improved solids removal, and has installed ultraviolet disinfection. The Department has imposed more protective limits for dissolved oxygen and ultimate oxygen demand (UOD) in the modified permit. Interim limits of monitor only are provided while the facility prepares an engineering study and implements a strategy to meet the more stringent limits. The facility is located at 3175 Staley Road, Grand Island and the modified permit will allow discharges up to 144,000 gallons per day of treated process wastewater to a Class D unnamed tributary of Big Six Mile Creek.

The Department has made a tentative determination to approve this modification. As a tentative determination, the Department is seeking public comment prior to making a final decision on permit issuance. A draft permit is available for review.

Project Description:

The Department has prepared a draft permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Act Amendments, and made a tentative determination to approve this application renewal for the existing facility-wide air emissions from the API Airtech facility at 91 North Street. The company manufactures heat exchangers and aftercoolers. Production processes include the cutting and forming of aluminum alloy stock, parts cleaning, powder coating and assembly by welding and brazing. The company is subject to 40CFR63 Subpart T - National Emission Standards for Halogenated Solvent Cleaning Machines because (PTE) trichloroethylene, a hazardous air pollutant (HAP), is emitted in excess of 10 tons per year (maximum of 15.51 tons per year).

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.
