The New York State Department of Environmental Conservation (NYS DEC) has received a Brownfield Cleanup Program (BCP) application from PS 6 Limited Partnership for a site known as the Cottage Gardens, site ID #C360119. This site is located in the City of Yonkers, within the County of Westchester, and is located at 33 Ashburton Avenue, Yonkers, NY 12701. Comments regarding this application must be submitted no later than September 19, 2011. Negative Declaration

Orange County - The Village of Montgomery Board of Trusteees, as lead agency, has determined that the proposed Clinton Street Planned Development District (PDD) will not have a significant adverse environmental impact. The action involves a combined PDD approval and rezoning of 0.38 acre parcel of land to PDD, site plan approval, subdivision and development of the PDD parcel by construction of a 4,000 square foot building, parking lot and access drives. The project site is located in the Village of Montgomery B-2 - Village Business District and under the Village's Zoning Code a PDD is a floating district that is applicable to such a project site pursuant to Board of Trustee's approval and Planning Board site plan approval. Allowable uses proposed for the PDD are a maximum of 7 residential units and a minimum of 2000 square feet of non-residential space and a maximum of 8,000 square feet nonresidential space. Only one additional two story building of 4,000 square feet in size is proposed to be added to the two existing buildings on the site. The project is located at 136 Clinton Street in the Village of Montgomery, New York.

Ulster County - The Town of Woodstock Town Board, as lead agency, has determined that the proposed Amendment to Local Law #2 of 1989, Zoning Law of the Town of Woodstock, Section 260-34: Wetlands and Watercourse Protection Standards will not have a significant adverse environmental impact. The action involves making revisions to reorganize several sections of the Zoning Law for consistency. No substantive changes are proposed and the applicability of the wetlands and watercourse protection standards will remain. The project is located throughout the Town of Woodstock, New York.

Westchester County - The Town of New Castle Town Board, as lead agency, has determined that the proposed Adoption of Local Law Concerning Proposed Amendments to Chapter 60 (Zoning) and Chapter 113 (Subdivision of Land) of the Code of the Town of New Castle will not have a significant adverse environmental impact. The action involves the adoption of a local law enacting new zoning text provisions (New Castle Town Code Chapter 60) and new subdivision regulation provisions (New Castle Town Code Chapter 113), pursuant to which proposed multifamily developments with five (5) or more dwelling units and proposed single-family developments with eight (8) or more dwelling units would be required to include no fewer than one (1) Model Ordinance Provisions Affordable Affirmatively Furthering Fair Housing (AFFH) Unit and potentially a greater number of such Units equal to at least 10% of the total number of dwelling units as the size of the residential development increases above a total of nine (9) dwelling units. These provisions would be applicable in all residential zoning districts of the Town of New Castle once the adopted local law takes effect. The project is located in the One-Family Residence Districts (R-2A, R-1A, R-1/2A and R-1/4A) and Multifamily Residence Districts (MFPD, MFR-M, and MFR-C) of the Town of New Castle, New York.

Notice of Acceptance of Final EIS

Westchester County - The Town of Mount Pleasant Planning Board, as lead agency, has accepted a Final Environmental Impact Statement on the proposed Taconic Tract Subdivision. The Final EIS is available from the Town of Mount Pleasant Planning Board Office (Town Hall), Mount Pleasant Public Library, Mount Pleasant Branch Library and on line at: www.mtpleasantny.com.

The action involves a proposed subdivision of 30.00 ± acres as a 17 lot subdivision, the majority of which is proposed to be developed as a conservation subdivision. The proposed project will subdivide three existing parcels into a total of 16 building lots, two of which already exist, for a total of 14 new building lots. Nine of the 16 homes will be on smaller size lots; the other 7 will be on minimum 1 acre lots. A seventeenth lot is included in this application solely because a portion of the access road travels over a small section of that lot. The proposed construction includes construction of 16 single-family residential dwellings, access roads, driveways, sanitary sewers, water supply facilities, stormwater management facilities, and landscaping. The road system will remain private and a homeowners association will be formed, of which every lot owner will be a member, which will be responsible for maintenance of the roads, stormwater management facilities and any common areas/open space in the Subdivision. The project is located between the Taconic State Parkway to the east, Washburn Road to the south, Todd Lane to the west and Carlton Avenue to the north in the Town of Mount Pleasant, New York.

The action involves the construction of four new laboratory buildings containing a total of 440,000 square feet of floor area devoted exclusively to research, design and experimentation, as well as associated parking, landscaping and related site infrastructure.& The project is located on the west side of Saw Mill River Road (Route 9A) on the Town of Mount Pleasant, New York.
