Project Description:

The applicant proposes a discharge of up to 20,192 gpd of treated sanitary wastewater to the Fifth Lake Outlet Channel, a Class A Waterbody (with an alternate discharge option of Fourth Lake - 500' from shore) from a new tertiary treatment plant with dual train sequencing batch reactor, aerated sludge holding tank, effluent rotary drum filtration, ultraviolet disinfection, post aeration, and a control building to be located at Fern Park in the Town of Inlet. The new sewer collection system includes 2,700 linear feet of forcemain, laterals, a main pump station, a duplex pump station and four grinder pump stations, and 3,400 linear feet of outfall sewer. Directional drill method will be used for forcemain crossing of Fifth Lake outlet and for the discharge outfall pipe to be located either in Fifth Lake Outlet Channel or Fourth Lake. The Department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statue is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project. SPDES #NY-0265853. This project is also under review by Adirondack Park Agency #2011-123.

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

A Structural-Archaeological Assessment Form has been completed. The proposed activity will not impact on registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Sep 09, 2011.
