Project Description:

The Department has made a tentative determination to approve this modification application for the SPDES permit to add an additional outfall (outfall 030) to an existing permit to discharge approximately 350 gallons per day of wastewater to the groundwater from a new onsite compost facility. The planned compost facility will treat high water content sludge generated at an existing onsite treatment plant for stormwater from deicing operations. Wood chips will be added to the sludge as part of the composting process. This operation will reduce the amount of sludge needed to be incinerated at the County Plant and will save an estimated $30,000 per year in disposal costs. The design of the planned compost facility and estimated wastewater generation rates are based on the results of a successful Sludge Composting Pilot Project that was completed last year.

This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance and as such, does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project. The proposed compost facility will be located in the northwest portion of the Albany International Airport property south of NYS Route 7 and east of Sicker Road West. A draft permit is available for inspection and comment at the Region 4 office.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Sep 09, 2011.

Project Description:

The Department has made a tenative determination to issue a new/revised SPDES permit to allow for the discharge of 7,000 gallons per day of sanitary wastewater to a tributary of the Wyomanock Creek from the existing Valley Plaza. The applicant is proposing to modify an existing SPDES permit to allow for the redevelopment of the plaza which will include the addition of a new Hannaford Supermarket and Pharmacy. The treatment system will include the construction of new septic tanks, grease trap, biological treatment and aeration and final polishing tanks.

This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance and as such, does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project. The facility is located at the northeast corner of US Route 20 and County Route 5A in the Town of New Lebanon. A draft permit is available for review and comment at the NYSDEC Region 4 office.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: New Lebanon Town Planning Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. The report of the survey is on file. No archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Sep 09, 2011.
