Negative Declaration

Ontario County - The Farmington Town Board, as lead agency, has determined that the proposed Adoption of the 2011 Edition of the Town's Comprehensive Plan will not have a significant adverse environmental impact. The action involves the adoption of a 2011 Edition of the Town's Comprehensive plan which is an update of the 2003 Edition and it is being undertaken as evidence of maintaining the ongoing comprehensive planning program for the Town of Farmington. The project is located throughout the Town of Farmington, New York.

Steuben County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed Bath Sand and Gravel Inc Mine Expansion will not have a significant adverse environmental impact. The action involves a proposal for a 6.7 acre expansion of an existing sand and gravel mine on a 25.5 acre property. The current permit authorizes operation in a 16.3 acre life of mine area. The 6.7 acre expansion proposed will increase the life of mine area to 23 acres. Expanded mining operations proposed will continue surface excavation of sand and gravel from above the local water table by mechanical equipment.

Proposed excavation will remove 20,000 to 30,000 cubic yards of sand and gravel from the site per year. Material will continue to be processed by a portable crushing and screening plant on site. Excavated sand and gravel will be stockpiled for loading onto trucks. The applicant has estimated maximum traffic from mining operations at 10 truck trips per hour.

Mining is not proposed below the local water table. Proposed final contours show grades that will retain storm water runoff within the mined area. No off site discharge of storm water runoff will be permitted. There are no NY State regulated streams or freshwater wetlands within the Life of Mine area.

Hours of operation proposed are unchanged from current operations. Final reclamation will restore the site to open meadow, with reclamation including the replacement of stockpiled topsoil, and seeding with an approved seed mixture.

The project is located on Moore Road, approximately 1.25 miles north of Turnpike Road, in the Town of Bath, New York
