Project Description:

The applicant is proposing to re-establish and rebuild a portion of the main channel of the Green River for the purposes of alleviating: 1) erosion; 2) loss of riparian and in-stream habitat and 3) downstream sedimentation. A portion of the Green River is severely eroding downstream of the deposition site. Approximately 4,883 cubic yards of accumulated material will be excavated from 700 linear feet of channel to drop the channel back to pre-deposition depth and width. In addition, the project will involve the installation of a full channel block, J-hook and root wads. The site is located on the west side of NYS Route 71 approximately 0.2 miles east of Green River Lane.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Aug 18, 2011.

Project Description:

Stiefel Laboratories, a GSK Company, has applied for a modification to their existing State Pollutant Discharge Elimination System (SPDES) permit (NY 019 1973). Stiefel is transitioning from a facility manufacturing dermatological products to a facility which will manufacture and package oral care products (i.e., toothpaste). A new wastewater facility is being constructed to treat the wastewater from the oral care manufacturing facility. The facility will discharge its treated process and sanitary wastewater to Catskill Creek and a Tributary to Thorp Creek, which have a class and standard of C(T) and C, respectively. The existing permit limits, requirements and conditions will cease with the ceasing of pharmaceutical production and the new permit limits, requirements and conditions will become effective as the new treatment facility starts treating the wastewater from the oral care manufacturing facility.

The Department has made a tentative determination to issue a SPDES modification under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought, or for the overall project.

SEQR Lead Agency: Durham Town Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Comments on this project must be submitted in writing to the Contact Person no later than Sep 02, 2011.
