Project Description:

The applicant is currently permitted to mine approximately 53.5 acres out of a total of 65 acres under their control. The applicant proposes to deepen the quarry within the existing footprint an additional 450 feet to a depth of -16 feet below mean sea level (MSL), which includes mining into the groundwater. All other aspects of the operation (rate of mining and processing) will remain the same.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

Roseton Generating Station began commercial operation in 1974. The facility consists of two Combustion Engineering tangentially-fired steam generating boilers rated at 600 megawatts (MW) each. Both units are capable of firing No. 6 fuel oil and natural gas as primary fuels. In addition, both units are capable of firing natural gas or No. 2 fuel oil as their ignition fuel during warm-up. An auxiliary boiler is also installed at the facility to provide heat and light for the facility if the larger units are not in use. The facility is a major source for Oxides of Nitrogen, Sulfur Dioxide and Particulates.

New Best Available Retrofit Technology (BART 6NYCRR Part 249) requirements are as follows: NOx - the existing emission limit is lowered from 0.25 lb/mmBtu to 0.20 lb/mmBtu (24-hr averaging during ozone season, 30-day averaging during non-ozone season) through wind box optimization effective 1/1/2014; SO2 - the annual weighted average sulfur limit for No. 6 oil is reduced from 1.3% to 1.0% effective 1/1/2014; PM - the existing limits of 0.1 lb/mmBtu on Units 1 and 2 remain in place with no additional controls.

By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the Draft Permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. The applicant proposes disturbance to a 200-foot section of Elm Hollow Brook [DEC Waters Index #D-70-20-25-5, class B(T)] for excavation of a channel through gravel deposits in the stream, and installation of a 200-foot heavy rock wall. The wall will be backfilled with the excavated gravel, and soil will be placed on top of the gravel in order to establish vegetative cover.

The Department has determined to renew existing SPDES permit NY 007 6376, which expired in 2002, as a Uniform Procedures Act Major groundwater discharge of industrial waste for a term of 10 years. Discharge consists of backwash from a water treatment plant in the amount of 3,000 gallons per day. The permit requires monitoring and submission of an annual report to the regional water engineer.
