Negative Declaration

Erie County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed Vail Road Mine Modification will not have a significant adverse environmental impact. The action involves an increase in the available acreage for mining sand and gravel at the Vail Road Mine by reducing the setback from Vail Road and expanding the approved life-of-mine limits on both sides of Vail Road. This modification adds 3 acres on the south side of Vail Road and 9.25 acres on the north side of Vail Road for a total mine acreage of 69.25. The use of a dry screen is also proposed. Reclamation goals of open space and agricultural field remain the same. The project is located on Vail Road approximately 0.5 mile east of South Quaker Street in the Town of Collins, New York.
