The department must consult further with OPRHP before making a final decision regarding the issuance of the permit.

Project Description:

The applicant proposes to excavate an area approximately 25 to 30 feet wide, 60 feet long, and 8 feet deep to inspect, and if necessary, repair a section of pipeline in the regulated adjacent area of New York State Freshwater Wetland BW-9. The proposed work area is located approximately 2,000 feet north of Love Road, 1,960 feet south of Staley Road, and 10,560 feet west of Baseline Road in the Town of Grand Island. All work will be performed along the pipeline right-of-way, within permanent easements. Proper sedimentation and erosion controls will be utilized to maintain the water quality of the wetland.

The Department has made a tentative determination to approve this application. As a tentative determination, the Department is seeking public comments prior to making a final decision on permit issuance.

Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0027057), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS). This modification will also serve to renew the SPDES permit, the term of which was extended under the State Administrative Procedures Act (SAPA).

The City of Lockport Wastewater Treatment Plant has a design average flow of 22 MGD. Current treatment includes preliminary treatment (grit removal and screening), primary settling, and secondary treatment which includes aeration, final settling, and chlorination. Sludge is pumped from primary clarifiers to the thickener tank, then to belt presses. The biosolids are trucked to the Lockport compost facility for processing to suitable product for land application.

The following changes to the permit are proposed: - The name of the Responsible Official or Agent has been changed. - A revised whole effluent toxicity (WET) page has been added. - A revised Combined Sewer Overflows (CSO) Long Term Control Plan requirement has been included. This revision recognized the City of Lockport's compliance with the CSO Control Policy and the ongoing Consent Order requirements. - A Storm Water Pollution Prevention Plan has been added. - A mercury minimization page has been added. - A short version of the Discharge Notification Act Requirements replaced the existing version. - Monitoring page with a new flow diagram was included.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to renew the Title V Permit. The compressor station is subject to the opacity limitations of 6NYCRR Part 227-1.3(a), the NOx emission limit in 6NYCRR Part 227-2.4(e)(1)(i) and applicable requirements of 40CFR 60 Subpart GG. The renewal includes piping/valve changes at the facility which would allow one of the four compressor turbines at the site to compress and transmit gas in either direction through the pipeline. Currently, gas can only be pumped in a southerly direction. This change at the compressor station is part of the Northeast Supply Diversification Project which is under review by the Federal Energy Regulatory Commission (FERC) (Docket N0. CP11-30-000). The four turbines at the facility will not exceed an emission rate of 83.77 tons of NOx per 12 month period and therefore the net NOx emission increase will be capped below the 40 ton per threshold of 6NYCRR Part 231-6 New Source Review. The modification to the permit is exempt from the State Environmental Quality Review Act, 6NYCRR Part 617 since it is being reviewed by FERC under the National Environmental Policy Act.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing.
