Project Description:

The New York State Thruway Authority is proposing the reconstruction of 15.5 miles of both Eastbound and Westbound lanes of the existing NYS Thruway (I-90) in the Towns of LeRoy, Stafford and Batavia, Genesee County. As a result of the proposed roadside safety improvements, culvert and bridge replacement and repairs, guiderail placement, etc. approximately 2.4 acres of state and federally regulated wetlands will be impacted. To mitigate the proposed wetland impacts the NYS Thruway Authority is proposing to develop 5 acres of new and enhanced wetland at the Tonawanda Wildlife Management Area.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Thruway Authority

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Aug 11, 2011.

Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0000167), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS). This modification will also serve to renew the SPDES permit, the term of which was extended under the State Administrative Procedures Act (SAPA). The following changes to the permit are proposed: - Updated Critical Receiving waters data. - Concentration limits for Chloride, Cyanide (free) and Total Dissolved Solids have been added.
