The Department has made a tentative determination to reissue the lapsed SPDES permit to discharge a maximum volume of 40,000 gallons per day of treated sanitary wastewater from outfall 001 to the tributary to Ellis Pond (Water Index No. CT-15-1-P113, Class A, and 3,900 gpd of treated sanitary wastewater from outfall M to groundwater through the septic tanks and leach field from the four buildings onsite. The submission of Discharge Monitoring Report (DMR) and the monthly "Wastewater Facility Operation Report" is required for the surface discharge facility whenever the facility is open. A draft SPDES permit (SPDES No. NY0103845) and Fact Sheet are available for review at the NYSDEC Region 3 office.

The applicant proposes to replace an existing potable water well and septic system within the 100 foot adjacent area of NYS Freshwater Wetland WF-28 (Class III). The well will serve all existing on-site development consisting of two existing single family homes, one of which includes an attached retail store. The well will be located approximately 30 feet from the wetland boundary. The septic system will only serve the building which includes the residence and attached retail store and will encroach within approximately 30 feet of the wetland boundary. Approximately 4,000 square feet of disturbance within the 100 foot adjacent area is proposed.

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

Project Description:

The New York State Department of Environmental Conservation (DEC) has received an application for a new State Pollution Discharge Elimination System (SPDES) Permit, pursuant to 6NYCRR Part 750, for the discharge of 3,000 gallons per day of treated sanitary waste water to Kiamesha Creek (Index # D-1-38-3, Class C). The proposed sewage treatment plant will service the Concord Monster Golf Course existing infrastructure, which formerly discharged un-treated waste into the Hudson River.

A draft SPDES permit with DEC proposed effluent limits and monitoring requirements is available for review at DEC Region 3 headquarters in New Paltz. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. Substantive comments on these permits or requests for a hearing or both must be submitted in writing to the contact person listed below
