Project Description:

The applicant proposes to dredge the channel between Braddock Bay and Lake Ontario to maintain access for boat traffic to the Braddock Bay Marina. No dredging is proposed at the Braddock Bay Marina as part of this project. As proposed, the outlet channel would be dredged to an elevation of 248.8 feet above mean sea level, which is a water depth of approximately 4.5 feet at low water. The dredge area would measure 1,200 feet long by 100 feet wide and a total of approximatley 15,500 cubic yards of material would be removed. Material would be dredged by hydraulic methods and the material would be placed approximately 1,000 feet east of the channel on the beach and below mean high water as beach nourishment. Under state regulation, Braddock Bay is designated as a navigable water body, Freshwater Wetland GR-1 (Class I), and coastal erosion hazard area. The applicant has filed a separate application with the Town of Greece for the necessary Article, 34 Coastal Erosion Management permit.

The applicant is proposing to conduct maintenance dredging of the Shumway Marina basin and an approximately 10 foot wide strip along the Shumway Marina breakwall along the Genesee River east shoreline to facilitate the continued operation of the marina and safe navigation. The applicant is proposing to dredge a maximum of 5,000 cubic yards of sediment annually over a 3 - 5 year term. Provided that the sediment testing confirms that dredged sediment meets the applicable requirements, the dredged sediment will be placed in the U.S. Army Corps of Engineer open lake disposal site. If the sediment does not qualify for open lake disposal the material would have to be taken to a permitted landfill or managed in accordance with a Beneficial Use Determination issued by the Department.

Project Description:

The Department has made a tentative determination to issue a Water Supply Permit and an Article 15 Excavation and Fill Permit to the Village of Ovid authorizing the installation of a new raw water intake pipe in Seneca Lake to serve the Village's potable water system. Additionally, the Village's permissive service area will be updated to reflect areas currently being serviced that are located outside the existing permissive service area. These areas to be added include the Finger Lakes Council - Boy Scouts of America property, the Verona Village Senior Citizen Complex, and lands adjacent to State Route 96/414, County Route 138A, State Route 96A, County Road 139 and State Route 96 as shown on the submitted permissive service area map. No increase in taking is proposed. The new 8 inch diameter Seneca Lake intake will be buried to a depth of 5-6 feet and extend out a total of 800 linear feet from shore. Ballast blocks of stone filled saddle bags will be used to anchor the new intake pipe and chemical feed line. The old intake will be abandoned and left in place. The Seneca County Health Department has reviewed and approved the proposed project. The corresponding Water Supply Application Number is #11,511.

Project Description:

The Department intends to issue an individual Water Quality Certification for impacts to federally protected waters of the US and associated mitigation of the following project. Applicant proposes to construct a 107-unit senior apartment complex with associated parking, and utilities including stormwater facilities that require NYSDEC construction SPDES permit. Installation of a sanitary sewer lines will be accomplished via open trench method. Access to property will require the crossing of One Lick Run a Class C non-navigable stream. Project includes installation of double 12-foot by 8-foot box culverts buried 2 feet below creek bottom. To mitigate floodplain impacts, they are also proposing to clean and widen creek by excavating 860 cubic yards from south bank in order to restore creek capacity. Modification includes lining creek channel with turf-reinforced matting and vegetating bank. Total creek disturbance is within approximately 540-foot stretch of creek.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
