Project Description:

The Department is prepared to issue an Individual Water Quality Certification for the placement of fill into approximately 0.232 acres of federally protected wetlands in association with the construction of Faith Village, a multi-phase commerical development, located at the southwest corner of Westfall and Winton Roads in the Town of Brighton, Monroe County. The project has received provisional approval, 2005-01311, from the Army Corps of Engineers under Nationwide Permit No. 39.

Project Description:

The Department has made a tentative determination to issue a permit modification to Waste Management of New York's existing solid waste management permit for the Rochester Transfer Station Permit to add an Eco-Park facility for collecting a variety of residential refuse items for recycling and reuse purposes including household hazards waste, pharmaceuticals, E-waste, compact fluorescents, waste tires, cooking oil, and many other items. Nonrecyclable items will be disposed of properly. The operator of Eco-Park will be Monroe County who will lease a portion of the existing building from Waste Management. The file is available for review and comment at the regional office.

The applicant proposes to remove the failing culvert and restore a 195 lineal foot section of the protected stream, ONT-114-2-1 (Class B), stream channel upstream of Imperial Drive; remove downed trees obstructing water flow downstream of Imperial Drive; plant live stakes with stone rip rap for erosion protection of the stream bank; and install a grassed overflow channel to handle seasonal high flows. The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0021610), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).
