Project Description:

The Department proposes to breach Earl's Pond dam (a road embankment) due to deficiencies including spillway capacity and the presence of trees on the dam. A new pipe arch culvert spillway that impounds less than six feet of water will be put into place. This new road embankment will then be below the NYSDEC Dam Safety threshold for a permitted dam. The waterway is Eaton Brook and is a protected stream, therefore, the permit will include a stream disturbance permit.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Jul 14, 2011.

Project Description:

Applicant proposes to construct a new addition to an existing cottage on a primary dune located within the regulated coastal erosion zone. The proposed addition, including demolition of an existing porch, meets the maximum allowable 25% footprint increase per the Coastal Erosion regulations.
