Project Description:

The Department has prepared a Draft Permit and has made a tentative determination to approve the application for the renewal of Title V Permit. Commander Terminal is a gasoline loading facility, consisting of seven (7) gasoline/ethanol storage tanks, one (1) 5800 gallon gasoline and one (1) 5800 gallon distillate tanks, eleven (11) distillate bulk storage tanks, one (1) 14,000 gallon tank for storage of recovered product, one (1) oil/water separator, and gasoline and distillate loading racks. There is no change in emissions from the previous permit.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. The Draft Permit and Permit Review Report may be viewed and printed from the Department web site at: http://www.dec.ny.gov/chemical/32249.html.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. Project Description:

The applicant proposes an increase of an existing discharge from 9,900 gpd to 25,000 gpd of untreated Reverse Osmosis Reject Water to Groundwater from the applicants facility located at 105 Emjay Blvd., Brentwood. The applicant plans to operate a Baby Wipes manufacturing facility.

The Department has made a tentative determination to issue a modified permit for a State Pollutant Discharged Elimination System permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior the making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for, or endorsement of, the activity for which the permit is sought or for the overall proposed project.

Refer to the application by the application number listed above and SPDES # NY 0267279. The proposed discharge is located within an area designated as a sole source aquifer. The following water purveyors have been identified as having service areas located within a 3 mile radius of the applicant's facility: SCWA, Brentwood Water District, and Dix Hills Water District.

Project Description:

The applicant proposes to install an 8 inch diameter irrigation well to a depth of 160 feet and having a pumping capacity of 400 gallons per minute. The water will be used to irrigate crops and for the care and maintenance of animals. The applicant's estimated yearly water use at the project site is 22.34 million gallons. Based on water requirements for the crops indicated on the site plan, supplemental irrigation requirements and typical rainfall statistics, the DEC calculated a yearly water use requirement of 6 million gallons. The project is located at 558 West Lane, 2,177 feet south of Sound Avenue, Aquebogue, Town of Riverhead, Suffolk County.
