Project Description:

The New York State Department of Environmental Conservation (DEC) has received an application for a new State Pollution Discharge Elimination System (SPDES) Permit, pursuant to 6NYCRR Part 750, for the discharge of 2,000 gallons per day of treated sanitary wastewater to the tributary to the Hudson River (Index # H-122, Class C). The proposed sewage treatment plant will service a proposed 22,800 sq. ft. commercial building on a 2.68 acre parcel located at 4185 Albany Post Road (Route 9).

In addition, construction of the proposed commercial building and associated site improvements will involve 0.091 acres of fill within waters of the United States (i.e. wetlands) and will require 401 Water Quality Certification from the Department.

A draft SPDES permit with DEC proposed effluent limits and monitoring requirements is available for review at DEC Region 3 headquarters in New Paltz. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. Substantive comments on these permits or requests for a hearing or both must be submitted in writing to the contact person listed below

Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0021890), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

The Warwick Sewer District #1 has a discharge of 0.43 MGD of treated sanitary wastewater to the Tributary of Longhouse Creek, a class B(T) water. The following changes to the permit are proposed: - Permit pages and conditions have been updated, renumbered and reordered, and reflect current permit language, DEC guidance, format and nomenclature. - Use of a recorder for continuous flow monitoring has been added. - CBOD5 mass limit and monthly average has been changed to reflect the change in design flow. - TSS mass limit has been changed to reflect the change in design flow. - Nitrogen, Ammonia limit has been reduced for sampling in accordance with new standards. - Total Residual Chlorine has been changed in accordance with regulatory standard for protection of aquatic life. - Footnotes have been updated and reordered.
