Project Description:

The Department has prepared a draft permit and has made a tentative determination to approve this application for renewal and modification of an existing Air Title V permit, pursuant to Article 19 (Air Pollution Control) of the New York State Environmental Conservation Law (ECL) and the Title V of the Federal Clean Air Act Amendments. The facility is an existing aerospace part testing, surface coating and surface finishing facility which is equipped with a paint shop consisting of nine spray booths, a drying oven and an exhaust from a storage room. The facility is regulated under 6 NYCRR Part 228, 6 NYCRR Part 226, 40 CFR 63.463 Subpart T, 6 NYCRR Part 212 and 40 CFR Part 63 Subpart N. The facility is seeking a Title V Permit as a contingency for possible increases in HAP emissions.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

This is a renotice of the proposed modification to the SPDES permit for the Port Jefferson Power Station. The Department originally issued a Notice of Complete Application on July 16, 2009 for the modification of the SPDES permit and received numerous public comments. As a result of the public comments the DEC has revised the draft permit. The primary changes to the draft permit are related to the cooling water intake and include; 1) elimination of the requirement to install a seasonal barrier net; 2) installation of coarse mesh ristroph-type traveling screens instead of fine mesh; 3) increase mortality reductions from impingement and entrainment (Impingement Mortality - 90% to 95%; Entrainment Mortality 65% to 80%); 4) condition requiring the facility to operate at less than 15% capacity; and 5) the submission of 6 month progress reports for verification monitoring. State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. The report of the survey is on file. No archaeological sites or historic structures were identified at the project location. No further review is accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29):

It has been determined that the proposed action is not subject to CP-29.
