Positive Declaration and Public Scoping

Ulster County - The Town of Marlborough Town Board, as lead agency, has determined that the proposed DMK Development LLC aka Dockside may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. A public scoping session will be held on June 9, 2011 at 6:30 p.m. at the Town of Marlborough Town Hall, 1650 Route 9W, Milton, New York. The action involves the rezoning of 20.2 acres of the site (a former sand and gravel quarry) to Residential (R) district; extend sewer service to the entirety of the project site. The project is located in the vicinity of 137 Dock Road in the Town of Marlborough, New York.

Notice of Acceptance of Draft SEIS and Public Hearing

Dutchess County - The Town of East Fishkill Planning Board, as lead agency, has accepted a Draft Supplemental Environmental Impact Statement on the proposed Montage at East Fishkill. A public hearing on the Draft SEIS will be held on June 7, 2011 at 7:30 p.m. at the Town of East Fishkill Town Hall, 330 Route 376, Hopewell Junction, New York. Written comments on the Draft EIS will be accepted for an additional ten (10) days following the close of the public hearing. Copies of the Draft SEIS and the site plans and proposed subdivision plat are available at Town of East Fishkill Town Hall and online at: www.montageateastfishkill.com.

The action involves a proposal to subdivide a 385.5 acre parcel into 122 new single family residential lots located on approximately 341.5 acres, with five open space lots, two utility lots, and one lot for an existing home and one 44 acre lot. The preferred plan is a conservation subdivision, serviced by central water and sewer services. The project is located along the south side of NYS Route 52 and opposite the intersection of NYS Route 216 in the Town of East Fishkill, New York.

Notice of Acceptance of Draft GEIS and Public Hearing

Westchester County - The Town of North Salem, as lead agency, has accepted a Draft Generic Environmental Impact Statement on the proposed Town of North Salem Comprehensive Plan. A public hearing on the Draft GEIS will be held on June 14, 2011 at 7:30 p.m. at the North Stalem Town Hall Annex. Copies of the Draft GEIS are avaialable at: Office of the Town Clerk, 266 Titicus Road, North Salem, NY 10560 and on line at: http://northsalemny.org/sites/defauIVfiles/GEIS05-11-11.pdf.

The action involves the adoption of the Town of North Salem Comprehensive Plan which will provide a blueprint of the Town's planning strategies and actions that are proposed for implementation throughout the next decade of development in the Town of North Salem. The Plan is intended to replace the 1985 Master Plan. The Plan includes a number of recommendations specific to land use and zoning, residential development, economic development, natural resource protection, traffic and transportation, community facilities and services. The Plan recognizes the changing conditions and needs of the Town and the development trends affecting the community and surrounding region. The project is located throughout the Town of North Salem, New York.

Notice of Acceptance of Draft EIS and Public Hearing

Westchester County - The City of New Rochelle City Council, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Locust Avenue Apartments. A public hearing on the Draft EIS will be held on June 14, 2011 at 7:30 p.m. at the City of New Rochelle Council Chambers, City Hall, 515 North Avenue, New Rochelle, NY 10801. Written comments on the Draft EIS will be accepted until 4:30 p.m. on June 24, 2011. The Draft Eis is available on line at: http://www.newrochelleny.com/.

The action involves the development of a rental apartment building which will include 98 apartments (5 studios, 41 one bedroom, and 52 two bedroom apartments), approximately 1,878 square feet of ground floor retail space. With regard to parking, as required by Code (§ 331-126) a total of 100 spaces are required including 98 for residential and 2 for retail. The residential requirement will be satisfied by the 98 indoor spaces (intended for the use of residents) while the retail requirement will be satisfied by designating 2 of the 7 surface spaces for retail use only. The remaining 5 surface spaces will be designated as "visitor parking" and will be available for use by retail customers or the residents' visitors. Covered parking will be provided to the residents for free. The proposal is for a mixed income building consisting of 39 units for households earning up to 60% of Westchester's Area Median Income (AMI) of $104,700, 19 units for households earning up to 90% of the AMI and 39 market rate units.

The components of the Proposed Action include: approval of zoning density bonuses from an underlying 2.0 FAR to a 4.6 FAR; site plan approval; a variance for surface level parking; and a waiver to allow a project that is not located within 500 feet of municipal parking, within the DB zoning district where a DDB floating zone overlay zone needs to be applied.

Pursuant to § 331-85.3 C (5), the project will require a waiver to allow a project that is not located within 500 feet of municipal parking, within the DB zoning district where a DDB floating zone overlay zone has been applied. Therefore, as part of this application, a waiver is requested from the City Council.

Further, since the zoning code requires that all required parking is to be subsurface, the proposed project will require a variance for the seven surface parking spaces.

Pursuant to the New Rochelle Zoning Code (see Section 331-154 Downtown Density Bonus (DDB) Floating Overlay Zone), the density bonuses to be applied to the development consists of additional FAR and height.

The project is located a 0.551 acre property at 17 Locust Avenue in the City of New Rochelle, New York. The project block is bounded by Locust Avenue to the west, Main Street to the north, and Franklin Avenue to the east. Clinton Place runs perpendicular to and terminates at the project site.
