Project Description:

The Department has prepared a draft permit (NY0091588) and made a tentative determination to approve the renewal to address the elimination of six remaining sanitary sewer overflows required by an Order on Consent executed by the Town of Grand Island. Additionally, pursuant to Environmental Conservation Law 17-0505 the draft permit contains an overflow retention facility (ORF) described as outfall No. 002. Discharges from the ORF will only occur after the plants full capacity has been utilized and maximized and capacity of the ORF has been reached. Monitoring for Mercury has been added to the permit in accordance with Division of Water policy. As a tentative determination, the Department is seeking public comment on the application prior to making a final decision on permit issuance. A copy of the application and draft permit are available for review and comment.

Project Description:

As part of the development of a 24-lot residential subdivision to be named Holly Ridge Estates, approximately 0.378 acre of a stormwater detention pond and 0.64 acre of wetland mitigation are to be sited in the regulated 100 foot wide adjacent area of NYS regulated Freshwater Wetland (FWW) OP-8. The wetland mitigation is compensation for 0.30 acre of Federally jurisdictional wetland proposed to be impacted by the development. A trail and boardwalk that totals 177 linear feet is also proposed. The proposed trail shall traverse the federal wetland mitigation area, through the outer 90 feet of the 100-foot regulated upland adjacent area to NYS FWW OP-8 and will connect to a 45 foot long raised boardwalk that will end with a 12 foot diameter raised observation deck within NYS FWW OP-8. The OP-8 Wetland is a class II wetland. The Holly Ridge Subdivision is located at the north end of Holly Ridge Lane.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The company proposes to convert scrap plastic, that does not have a reasonably available recycling market, using pyrolysis, into liquid and gaseous materials which are recovered for utilization. The liquid will be sold to the refining, fuel and polymer production markets. The gaseous materials will be used as fuel to provide heat for the process. In addition to the Solid Waste Permit the company has applied for an Air State Facility Permit (DEC Application No. 9-2911-00348/00002) under Article 19, 6 NYCRR Part 201.
