Project Description:

The department has drafted a renewal permit pursuant to Article 19 (Air Pollution Control) of the Environmental Conservation Law and Title V of the Federal Clean Air Act Amendments and made a tentative determination to approve this application for the existing facility located at the DANC Solid Waste Management Facility, 23400 State Route 177, Rodman, NY 13682. This Title V renewal application for the DANC SWMF (Permit ID# 6-2252-00007/00015) is to include emissions from the Innovative/DANC LLC landfill gas to energy (LFGTE) project (Permit ID# 6-2252-00018/00001) for regulatory applicability review as a single facility. The two plants propose to maintain separate Title V permits. A single facility is allowed to maintain multiple permits under 6 NYCRR Part 201-6.

The DANC SWMF is owned and operated by the Development Authority of the North Country. The DANC SWMF is a 6 NYCRR Part 360 landfill currently operating under NYSDEC Air Facility Title V Permit No. 6-2252-00007/00015. The facility is permitted for the operation of one (1) 3,000 scfm open candlestick flare, one (1) 1,100 scfm open candlestick flare, and up to eight (8) portable, passive candlestick flares. The 1,100 scfm open candlestick flare is transferred to the Innovative/DANC Title V permit as part of this permit action. Emission units at the facility consist of 1-LFGAS (landfill gas emissions associated with the uncontrolled (fugitive) release of landfill gas and emissions from the control of landfill gas) and 3-LCHST (fugitive emissions associated with on-site leachate storage). DANC is not required to operate an active landfill gas collection and control system by regulation, but has elected to voluntarily install and operate the system to reduce odors and GHG emissions.

The Innovative/DANC LFGTE plant (Permit ID# 6-2252-00018/00001) is owned and operated by Innovative Energy Systems. The Innovative/DANC LFGTE plant utilizes treated landfill gas generated at the DANC SWMF (Permit ID# 6-2252-00007/00015) as an energy source to generate electricity for subsequent sale. The plant consists of three (3) existing and two (2) proposed (for a total of five (5)) Caterpillar 3520C landfill gas internal combustion engine generator sets. The facility will also operate the 1,100 scfm open candlestick flare which was originally permitted to the landfill to control excess gas that the engines cannot utilize.

Emissions of carbon monoxide (CO) from the Innovative DANC LFGTE project will be capped at 240 tons per year which is less than the Prevention of Significant Deterioration (PSD) major project threshold. Emissions of CO from the facility composed of both plants will be capped at 263 tons per year. From this point forward the facility will be considered a major facility under the state PSD program (6 NYCRR Part 231-7).

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Project Description:

This Department has received a request for a renewal to a permit to operate air pollution emission sources and has drafted pursuant to Article 19 (Air Pollution Control) of the Environmental Conservation Law, a Title V Facility Permit, for the facility located at Innovative/DANC LLC, Town of Rodman, Jefferson County, New York. This facility is engaged in the generation of electricity from the combustion of landfill gas captured at the Development Authority of the North Country (DANC) Solid Waste Management Facility. The Standard Industrial Classification representative of this facility is 4911, Electric Services.

Innovative/DANC LLC is proposing a project consisting of three (3) existing (and permitted) and two (2) proposed (for a total of five (5) Caterpillar G3520C) landfill gas engine generator sets. Potential to emit (PTE) emissions from this project also include emissions from a 1,100 scfm candlestick flare (emission source: F0010) to combust excess landfill gas that the engines cannot utilize. This flare was previously permitted on the DANC SWMF Title V permit # 6-2252-00007/00015, but this modification proposes to remove the flare from the DANC SWMF permit and add it to the Innovative/DANC LLC permit. The 3,000 cfm open candlestick flare at the DANC SWMF (Permit # 6-2252-00007/00015, emission source: F0999) will be utilized as a backup landfill gas combustion device when the landfill gas engines at Innovative/DANC LLC are not able to handle the entire amount of collected landfill gas.

Emissions of carbon monoxide from the Innovative/DANC LFGTE project will be capped at 240 tons per year which is less than the PSD major project threshold. A siloxane removal system will be installed prior to startup of engine 4 (emission source: 04ENG). This system will be tested for a maximum of 18 months to verify removal performance meets manufacturer guarantees prior to installation of the oxidation catalysts for CO control. Oxidation catalysts will be installed on engine 4 (emission source: 04ENG) following the test period of the siloxane removal system, and on engine 5 (emission source: 05ENG) prior to startup. Engines 1 through 3 (emission sources: 01ENG-03ENG), which are currently installed and operating with a CO emission limit of 3.0 g/bhp-hr, shall be reduced to a CO emission limit of 2.5 g/bhp-hr following installation and startup of the siloxane removal system and prior to the installation of engine 4 (emission source: 04ENG). During the interim siloxane removal system test period, engine 1 through 4 ) shall be limited to 2.5 g/bhp-hr of CO.

During the siloxane removal system interim test period annual operation of engines 1 through 4 (emission sources: 01ENG-04ENG) shall be limited to 98.5 percent runtime during any 12-month period and the 1,100 scfm flare (emission source: F0010) shall be limited to 50 percent combustion capacity during any 12-month period. Following installation of the oxidation catalyst on engines 4 and 5 (emission sources: 04ENG & 05ENG) the CO emission rate shall be limited to 0.55 g/bhp-hr.

The Innovative/DANC LLC plant and DANC SWMF shall be considered a single facility for all air pollution control regulations applicability determinations. The PTE of any air pollutant from this single facility shall be based on the maximum landfill gas flow rate of 4,209 scfm (expressed as 50% methane). Emissions of carbon monoxide from the DANC SWMF and Innovative/DANC plants will be capped at 262 tons per year.

The department has prepared a draft permit and has made a tentative determination to issue a renewal Air Title V permit at the existing facility, Lyonsdale Biomass LLC, 3823 Marmon Road, Lyonsdale, NY 13368, Lewis County.

The Lyonsdale Biomass Facility is a 290 mmBtu per hour wood fired power plant with 19 MW rated output. The facility is currently permitted to burn clean, unadulterated wood. The facility is subject to Title V, and 40 CFR 60, Subpart Db. The facility is a Title V major for NOx, CO, PM, and PM-10. The facility is capped at 249 tons per year for NOx and CO to avoid PSD applicability. To control PM and PM-10 emissions, the facility uses an Electrostatic Precipitator (ESP). The facility also is subject to the Compliance Assurance Monitoring (CAM) rule, which codified under 40 CFR 64.

Project Description:

This Department has received a request for a permit modification to operate air pollution sources and has drafted pursuant to Article 19 (Air Pollution Control) of the Environmental Conservation Law, a Title V Facility Permit and has made a tentative determination to also modify the Part 360 Solid Waste Management Facility permit to include the landfill gas to energy facility for the Ava Landfill located in the Town of Ava, Oneida County, New York. The facility is a landfill that accepts municipal solid waste. The Standard Industrial Classification representative of this facility is 4953, Refuse Systems.

OHSWMA Regional Landfill opened and began receiving and placing waste in October 2006. The facility operates landfill gas collection and control devices to combust landfill gas and destroy methane to reduce odors and greenhouse gas emissions. The facility is not required to install or operate the devices in order to comply with federal New Source Performance Standards (NSPS) at this time. Permitted emission units include 1-LFGAS, 2-VHCPM and 3-LCHST. Existing permitted emission sources include up to 24 portable passive candlestick flares (emission sources: F0001 - F0024) and one active candlestick flare (emission source: F0025). In addition the facility operates exempt and trivial activities including emergency generators, fuel storage tanks, building heaters, and mobile equipment.

This Title V Permit Modification is to include emissions from a proposed landfill gas to energy (LFGTE) plant consisting of three (3) Caterpillar 3520C landfill gas engine generator sets to be owned and operated by Waste Management Renewal Energy (WMRE), LLC (DEC Title V Permit ID: 6-3024-00025/00001). The LFGTE plant will be the primary control system for landfill gas generated by the OHSWMA Regional Landfill. OHSWMA Regional Landfill and WMRE, LLC will hold separate Title V Air Permits; however, for the purposes of New Source Review (NSR) applicability they are considered a single facility and will share a common emission cap for combined carbon monoxide (CO) emissions to ensure the facility does not exceed the major facility threshold.
