Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a modification to the Title V Air Facility Permit for the operation of the Global Companies Albany Terminal facility located at 50 Church Street in the Port of Albany, City of Albany, County of Albany, owned by Global Companies LLC.

The proposed modification involves reallocating the quantities of petroleum products loaded from the terminal to barges, railcars and tanker trucks. The facility is also adding gasoline blending operations to the terminal and utilizing 6 existing gasoline storage tanks to store gasoline components, and for blending of gasolines.

The facility would also reallocate existing throughput caps to maintain thresholds below applicability of 6 NYCRR 231-6. The facility recalculated their emission profile using existing limits and netting to show that they are below the thresholds for applicability of 6 NYCRR 231-6. A new vacuum assisted vapor reduction system would be installed at the truck rack. The new system is rated at 2 milligrams/liter of gasoline/ethanol loaded and would replace the current system which has emissions of 10 mg/liter.

The facility is major for Volatile Organic Compounds (VOC). Also the facility is not applicable to 40 CFR 63, Subpart R because the facility is not major for Hazardous Air Pollutants (HAP), although the facility is subject to the requirements of 40 CFR 63, Subpart BBBBBB the area source NESHAP.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a new Air State Facility permit to the Stratton VA Medical Center. The new permit will cover the operation of the facility's 3 existing 27.1 million Btu/hour dual fuel boilers and a new 16.7 million Btu/hour boiler capable of firing natural gas and No. 2 fuel oil.

Persons wishing to inspect the draft permit and the application files with all relevant supporting materials available to the DEC (the "permitting authority") that are relevant to this permitting decision, should contact the DEC representative at the address below. It is recommended that an appointment be made to confirm the availability of the subject files. The DEC will endeavor to make the files available within two business days of contact, during normal business hours (8:30 a.m. through 4:45 p.m.), unless the requestor wishes to inspect the files at a later date.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. A public hearing may be legislative or adjudicatory. A legislative public hearing is a proceeding which provides an additional opportunity for public comment. DEC's determination to hold a legislative public hearing will be based on whether a significant degree of public interest exists. If a legislative public hearing is to be held, a Notice of Hearing will be published which will include the time and place of the hearing and submitting comments. The applicant and all persons who have filed comments on the permit will be notified by mail of the public hearing. Comments and requests for a legislative hearing should be in writing and addressed to the Department representative listed below.

An adjudicatory public hearing is a trial type proceeding which provides the opportunity for adjudication on the basis of evidence, including direct testimony and cross examination. An adjudicatory hearing is held only if substantive and significant issues relating to any findings or determinations the Department is required to make pursuant to the Environmental Conservation Law exist. If comments are received which raise significant issues or provide additional relevant information, the Department may modify the draft permit.

Project Description:

The applicant proposes to modify an existing permit to allow construction of a trailer loading pit on the north side of the existing processing building. This involves a ramp to grade down to the pit, an expansion of the building to fully enclosed the new loading pit. The expansion area is approximately 25 feet, with the pit at 13 feet wide and an expansion of the building processing floor of 12 feet. This also requires cutting back of the existing soil slope on the north side of the existing building. No throughput or material character changes proposed. The project is located off State Route 23 on Tim-Loeffler Road.

Permit Renewal and Modification to the life of mine (LOM) boundary of an existing permitted Peat Mine from 95.5 acres 108.17 acres of which 45.33 acres will be authorized to be affected during this permit term.
