Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) and Renewal to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0020320), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS). The Town of Addison Wastewater Treatment Plant discharges 0.42 million gallons per day of treated municipal effluent to the Canisteo River. The following changes to the permit are proposed to be added: 1) Mercury Minimization Program, 2) Chesapeake Bay Action limits for Total Nitrogen and Phosphorus, and 3) a compliance schedule to optimize treatment and for plant evaluation to meet possible future Chesapeake Bay limits. As a tentative decision, the Department seeks comments prior to making a final decision. The application file is available for review and comment at NYSDEC Region 8.

Project Description:

The Department proposes to renew and modify an existing General Permit to authorize various stream maintenance, stabilization and crossing projects conducted by the Wayne County Soil & Water Conservation District (SWCD) and their cooperators. These projects include the following 11 types: 1) removal of trees and/or debris that are blocking or impeding navigation or drainage, 2) placement of heavy rock rip rap for up to 500 feet in any 2,000 lineal feet of stream for bank protection, 3) implementation of bioengineering practices involving less than 2,000 lineal feet of stream, 4) the maintenance, repair and replacement of existing culverts, 5) The maintenance, repair, in-kind and in-place replacement, or minor modification of existing structures and improved areas, including but not limited to rip rap, retaining walls, gabion structures, headwalls, and plunge pools, 6) Maintenance removal of bed material within 50 feet of an existing culvert or bridge, 7) Removal of up to 750 cubic yards of bed material, which has been determined to be greater than 90% sand, gravel and stone, and involving less than 2,000 lineal feet of stream, 8) The removal of up to 750 cubic yards of bed material that will be placed on the landowner's property, 9) One stream crossing of less than 25 feet wide in any 1,000 lineal feet of stream length for machinery 10) The placement of up to four bed sills in any 2,000 lineal feet of stream for the purpose of grade control and 11) The installation of up to 12 in-stream stabilization structures, including but not limited to rock vanes or cross vanes, within any 2,000 lineal feet of stream. Once issued, the Wayne County SWCD would be required to request project-specific coverage under the General Permit for cooperating individuals and municipalities throughout the term of the permit, which would be one to five years.
