Project Description:

This project consist of the construction of two landform embankments and an ice control structure. The first landform is situated immediately south east of the intersection of State Routes 28 and 168. This component will consist of an earthen landform (berm) approximately 600 feet long with associated drainage appurtenances and curbing, 150 feet of riprap stream bank protection and 150 foot long by 8 feet high concrete retaining wall. The second structure will be 1,600 feet south east of the referenced intersection and will consist of a 340 foot long landform. There will also be drainage appurtenances, riprap protection and restoration of surfaces. The ice control structure will be located approximately 3,400 feet south east of the intersection. The major componentas include five in-stream 8 foot high concrete piers, excavated bypass channel, access road and staging area, placement of large boulders, riprap bank protection and the raising and restoring of State Route 168. An Environmental Assessment (EA) dated January 2006 was prepared in accordance with the National Environmental Policy Act of 1969 (NEPA) and a Finding of No Significant Impact (FONSI) dated April 2006 have been filed by the Army Corp of Engineers.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

SEQR Lead Agency: US Army Cops of Engineers

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. The report of the survey is on file. No archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than May 26, 2011.

Project Description:

The Department has made a tentative determination to issue a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. The approved application is for a discharge of approximately 9500 gallons per day to groundwater from 5 sanitary outfalls at a campground consisting of 173 sites on approximately 37.3 acres. This tentative determination indicates that the discharge regulated under this statute satisfies regulatory standards for permit issuance, based on the information available to the Department at this time. As a tentative determination, the Department seeks comments on the regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for, or endorsement of, the activity for which a permit is sought for the overall project.
