On April 12, 2011, by Resolution 365-2011, the Town of Oyster Bay awarded a contract to Winters MSW Holdings, LLC pursuant to section 120-w (one hundred twenty-w) of the general municipal law for the transfer, haul and disposal of solid wastes from the Town of Oyster Bay Solid Waste Disposal District. The validity of this contract or the procedures which led to its award may be hereafter contested only by action, suit or proceeding commenced within sixty days after the date of this notice and only upon the ground or grounds that: (1) such award or procedure was not authorized pursuant to that section, or (2) any of the provisions of that section which should be complied with at the date of this publication have not been substantially complied with, or (3) a conflict of interest can be shown in the manner in which the contract was awarded; or by action, suit or proceeding commenced on the grounds that such contract was awarded in violation of the provisions of the Constitution.

Notice of Acceptance of Draft EIS and Public Hearing
Suffolk County - The Town of Brookhaven Town Board, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Mount Sinai Industrial, LLC (aka The Mount Sinai Village Centre) Change of Zone. A public hearing on the Draft EIS will be held on June 14, 2011 at 6:30 p.m. at the Brookhaven Town Auditorium, 2nd Floor, Town Hall, One Independence Hill, Farmingville, NY 11738. Written comments on the Draft EIS will be accepted until June 25, 2011. Copies of the Draft EIS are available for review at the Town of Brookhaven Town Hall, the Port Jefferson Free Library, and the Comsewogue Public Library. The Draft EIS is also available on line at: www.brookhaven.org.
The action involves a change of zone from L-1 Industrial, J-2 Business and A-1 Residential (30.32 acres) to entirely J-Business-2 zoning to allow for the development of approximately 231,996 square feet of commercial spaces, approximately as: 184,560 square foot of retail space, 38,789 square foot of office space, 3,745 square foot bank and a 4,902 square foot (100 seat) restaurant. The Mt. Sinai Village Centre project is designed as a mixed-use village center project incorporating office, restaurant and retail shops supported by anchor and sub-anchor retail stores. An additional approximate 1,062 square foot of non-commercial floor area is proposed, for a total building area of approximately 233,058 square foot. The project is located on the south west corner NYS Route 25A and County Route 111 (not constructed) in the hamlet of Mt. Sinai, Town of Brookhaven, New York.

Notice of Acceptance of Final EIS
Suffolk County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has accepted a Final Environmental Impact Statement on the proposed Northwind Village. The action involves the annexation by the Village of Greenport of a 17.2 acre parcel currently located in the Town of Southold adjacent to the northwest border of the Village. Once annexed, the site is proposed to be developed with a 128 unit mixed-income affordable housing development, consisting of one, two, and three bedroom homeownership units, access roadway, driveways, common areas, and landscaping. The proposed project will create 64 affordable units (50% of the total units) as defined by Suffolk County, which will be subject to price, sale, resale, and ownership controls - collectively known as "affordability" restrictions. The project is located on the south side of Suffolk County Route 48 (North Road), approximately 1,600 feet east of Chapel Lane in the Town of Southold, New York.

Notice of Acceptance of Final SEIS
Suffolk County - The Town of Brookhaven Town Board, as lead agency, has accepted a Final Supplemental Environmental Impact Statement on the proposed Artist Lake Plaza (a.k.a. Breslin Realty) Change of Zone. The Final SEIS is available at the Town of Brookhaven Town Hall, Longwood Public Library and on line at: www.brookhaven.org.
The action involves a change of zone of 32.89 acres of a 74.24 acre site, from A-Residence-1 zoning to J-Business-2 zoning. The proposed project involves the removal of the vacant K-Mart structure and development of two large anchor stores (approximately 314,330 square feet) and seven smaller retail buildings (approximately 65,081 square feet). The project provides parking and amenities to support the retail use and proposes sidewalks, and an open-air public walking and gathering areas. Pedestrian linkages to new sidewalks to be installed along the site's frontage on NYS Route 25 are proposed, for pedestrian and aesthetic enhancement, and to provide public access to future improvements along Artist Lake. The project is located at 1075 Middle Country Road in Middle Island, Town of Brookhaven, New York.
