Project Description:

As part of the "Cuba's Landmark Connections to the Genesee Valley Greenway" project, the Village of Cuba proposes to improve an approximate 1 mile section of the New York State Genesee Valley Greenway trail system by adding stone fill to the existing, abandoned railroad bed, of which 11,926.5 sq. ft. will be located within the regulated 100-ft. wide Adjacent Area of State Freshwater Wetland CU-6. The project site is located about 3,000 ft. west of the Village of Cuba, south of I-86 and Rte. 446, north of West Cuba Road.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than May 05, 2011.

Project Description:

The Department has prepared a draft permit (NY0202801) and made a tentative determination to re-issue the permit for the surface discharge of a maximum of 5,000 gallons per day of treated sanitary wastewater to a tributary of Cassadaga Creek which has a Class and Standard of C. The Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought.
