Project Description:

The Department has made a tentative determination to approve this modification application for SPDES permit to discharge 8,000 gallons per day (gpd) of sanitary wastewater to an unnamed tributary to the Kline Kill stream for the Camphill Ghent Elder Care Facility. The treatment system will include the construction of new septic tanks, a flow equalization tank, primary and secondary biological treatment, a sand filter and UV disinfection. A previous SPDES permit was issued on November 4, 2010. This modification involves a reduction in flow from 13,000 gpd to 8,000 gpd and a change in the 30 day BOD limit from 5 mg/L to 10 mg/L.

This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance and as such, does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project. The proposed facility is located on the west side of NYS Route 66 approximately 1/4 mile south of the Village of Chatham. A draft permit is available for inspection and comment at the Region 4 office.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Ghent Town Planning Board

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than May 20, 2011.
