Project Description:

The Department has received an application from Buckeye Terminals LLC, has prepared a draft permit, and has made a tentative determination to issue a renewal of the Title V Facility Permit for the Rochester South Terminal, a gasoline, diesel fuel, and heating oil loading facility. The Rochester South Terminal is subject to 6 NYCRR Part 201-6, Title V Facility Permits, for major stationary sources due to potential emissions of volatile organic compounds (VOC) in excess of 50 tons per year.

The facility includes a 4 bay truck loading rack with a vapor recovery unit to control loading emissions, a vapor combustion unit as a backup control method, six large fixed roof gasoline storage tanks with internal floating roofs, five tanks for additives and one tank for diesel fuel. The Title V Permit was originally issued in 1999, was renewed in 2004, and was modified in 2008 to authorize 6 additional ethanol tanks for blending to allow compliance with federal regulations for ethanol in gasoline.

Buckeye proposes to maintain existing Permit Conditions to restrict the facility potential to emit Hazardous Air Pollutants (HAP) to below 10 tons per year of any individual HAP, and 25 tons per year of all HAP compounds combined, the thresholds specified in 40 CFR 63 Subpart R Maximum Achievable Control Technology for Gasoline Distribution Facilities. These Conditions limit facility throughput to 230,000,000 gallons of gasoline and 170,000,000 gallons of distillates annually, and are unchanged from the initial Title V Permit.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes to restore a 350 lineal feet section of Buckland Creek by creating a more natural meandering channel, installing two in-stream boulder cross vanes, creating a benched stream bank and planting of the riparian area. Water will be pumped around the work area to prevent water quality impacts during construction.

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
