Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0104809), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

This modification also includes a permittee requested modification to increase the design treatment capacity from 30.5 mgd to 40.5 mgd. The proposed expansion work will be completed under two phases of construction. Current treatment includes influent screening, influent pumping, grit removal and primary sedimentation; activated sludge process, secondary sedimentation and chlorination. The facility processes sludge and sends dewatered sludge off site. The facility has surface discharges to the Atlantic Ocean, a class SA water.

The following changes to the permit are proposed: - Permit pages and conditions have been updated to reflect current DEC guidance, format and nomenclature. - The names and addresses of the facility and the permittee have been updated.- Footnotes have been updated and reordered. - Permit limits, levels and monitoring requirements have been modified to reflect the design flows, 30.5 mgd, 38.5 mgd and 40.5 mgd. The effluent limits and action levels have been developed following the technology based effluent limitation, water quality based effluent limitation, and best professional judgment. - The permittee has developed a pollution minimization program for mercury. Therefore, the special conditions for mercury have been removed. - The compliance requirements under the sludge management program are complete, and have therefore, been removed. - Total Residual Chlorine compliance schedule has been updated. - Action levels for Whole Effluent Toxicity Testing have been revised. - Action levels for parameters have been revised for the design of 38.5 mgd and 40.5 mgd. For the design flows 38.5 mgd and 40.5 mgd, Total Ammonia (as NH3 -N), a pollutant in the current permit has been changed to Total Ammonia (as NH3). Additionally, the effluent limit for Total Ammonia (as NH3) is a monthly average limit. - Warm season has been revised to May 1 to October 31.

Project Description:

The Department has made a tentative determination of approve a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. The applicant plans to operate a Baby Wipes manufacturing facility. The facility will include a new discharge of 40,000 gpd of untreated reverse osmosis reject water, which will be directed to groundwater. This tentative determination indicates that the discharge regulated under this statute satisfies regulatory standards for permit issuance, based on the information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for, or endorsement of, the activity for which a permit is sought of for the overall proposed project. The proposed discharge is located in an area designated as a sole source aquifer. The following water purveyors have been identified as having service areas located within a 3 mile radius of the applicants facility: SCWA, Brentwood Water District, Dix Hills Water District.
