Project Description:

The Department has prepared a draft SPDES Permit (NY 0031844) modification and made a tenative determination to approve the discharge of up to 0.215 million gallons per day (30 day design average flow) of treated wastewater, from the village's proposed new wasterwater treatment plant, to the Genesee River. The existing plant has a limit of 0.155 million gallons per day. Effluent limits would be increased to reflect the new plant's capacity. Chlorine residual measurement would be removed from the permit since the plant will use ultraviolet disinfection. A phosphorus limit and a mercury minimization plan would be added to the permit. The proposed permit would take effect upon completion of the new plant. The Department is seeking comments on the proposed permit modifications prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought. When commenting, please refer to this application by both the application number and the SPDES number listed in this notice. A draft permit and application materials are available for inspection/review in the Region 9 Buffalo Office.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

The applicant proposes the mining of sand and gravel, and material processing with a portable dry-screen and portable crusher, each with a capacity less than 150 tons per hour, ultimately affecting 11.28 acres of land. The reclamation objective is wildlife habitat. The proposed mine location is approximately 1,500 feet north of NYS Route 98 and 1,200 feet west of Hughs Road. The haul road connects to Route 98, approximately .1 mile east of the intersection with Galen Hill Road.

Project Description:

The City of Niagara Falls proposes improvements to LaSalle Water Front Park on the Niagara River. Work along the shoreline would include construction of a gazebo, a floating dock for fishing and two additional fishing access points comprised of tiered ledgestone boulders. Approximately 162 feet of riprap is proposed to be installed at the eastern end of the park to protect the river bank from erosion.
