Project Description: The project consists of development of 85 units of multi-family housing including 21 duplex units and 9 multi-family housing units, to be served by municipal sewer and water services.


Negative Declaration

Essex County - The Town of Westport, as lead agency, has determined that the proposed Amendment to Zoning Law regarding Farm Related Private Membership Club Use will not have a significant adverse environmental impact. The action involves the addition of a new land use called "Farm-Related Private Membership Club" (allowable only upon receipt of a Special Permit) to the town zoning law. The new land use will be added to the V-RES I and V-MGT districts, both of which are within the former Village of Westport. The project is located throughout the Town of Westport, New York.

Essex County - The Town of Westport, as lead agency, has determined that the proposed Local Law #2 of 2011 to amend the Land Use Law in Relation to Non-Conforming Uses will not have a significant adverse environmental impact. The action involves the adoption of a zoning amendment that will allow for replacement of a pre-existing, non-conforming use with a new non-conforming use. This amendment is limited to the following districts in the former Village of Westport; V-RESII (n, V-RES III, V-FAC, V-MGT, V-IND districts. These districts are entirely within an Adirondack Park Agency designated "Hamlet" land use area. A new non-conforming use may be undertaken only upon issuance of a Special Permit by the planning board, provided that the new non-conforming use is less non-conforming and/or will be more compatible with the neighborhood than the existing non-conforming use. The project is located throughout the Town of Westport, New York.

Fulton County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed E. J. Simek Mined Land Permit Application will not have a significant adverse environmental impact. The action involves the proposal to establish a new 19 ± acre sand mine on lands owned by the applicant. The project site is situated on a contiguous parcels totaling 23 + acres is located off County Route 122 immediately adjacent to the Ferndale Cemetery mine. The operation will consist of the removal of sand from the site by front end loader, and material screening by portable equipment. Material will be hauled through a right-of-way through lands of William Smith The project is located on County Route 122 in Johnstown, New York .

Saratoga County - The Town of Moreau Town Board, as lead agency, has determined that the proposed Amending Chapter 149 "Zoning" of the Code of the Town of Moreau will not have a significant adverse environmental impact. The action involves the revision of the Zoning Code to add the definitions of "domicile" and "transient"; revise the definitions of "dwelling", "hotel", "inn", "tourist cabin", "motel" and "bed-and-breakfast establishments"; repeal the current definitions of "lodging house", "boarding house", "rooming house" and "tourist home"; add a new Section 149-52A "Special provisions for hotels, inns, tourist cabins and motels"; revise Section 149-67 "Penalties for offenses"; and revise the Schedule of Regulations for C-I Zone by deleting the reference to "lodge". The project is located throughout the Town of Moreau, New York.

Saratoga County - The Town of Wilton, as lead agency, has determined that the proposed Floral Estates Phase V Conservation Subdivision will not have a significant adverse environmental impact. The action involves the subdivision of 43 ± acres of land zoned R-2 into 18 residential single-family lots each approximately 1.37 acres. The project is located on Ingersol Road in the Town of Wilton, New York.
