Project Description:

This Department has received a request to modify a permit and has drafted pursuant to Article 19 (Air Pollution Control) of the Environmental Conservation Law, an Air State Facility Permit, at the facility located at Superior Plus Energy Services; 9678 River Rd, Town of Marcy in Oneida County. This facility is a Petroleum storage and distribution terminal, consisting of a tank farm which includes two tanks that store gasoline, as well as several distillate fuel storage tanks. Also on-site is a loading pad with several bays, all connected to a vapor destruction unit.

The Department has made a tentative determination to approve the application for the modification of the State Facility Permit. The modification to the State Facility Permit allows the operations of two emission units, the storage tanks for gasoline and petroleum distillates, and ethanol and the loading rack with control equipment. The facility has capped out of Title V Permitting requirements and 40 CFR Subpart Kb requirements by tracking and restricting its emissions of Hazardous Air Pollutants below individual emissions of 10 tons per year and cumulative emissions of 25 tons per year. Also the facility capped out of Title V requirements by tracking and restricting Volatile Organic Compounds (VOC) under 50 tons per year. This is accomplished by limiting the throughput of gasoline and distillate through the facility. This limitation on gasoline throughput also is established to limit the amount of requirements under 40 CFR 63 Subpart BBBBBB.

The draft permit with all conditions is available for review in the Region 6 NYSDEC sub-office in Utica, NY.

The applicant proposes to apply the biological pesticide Bacillus thuringensis (subspecie israelensis) and Bacillus sphaericus to various standing water areas in wetlands in the vicinity of the hamlet of Colton, South Colton and Higley Flow. Portions of state regulated freshwater wetlands CO-18, CO-19, CO-20, CO-21, CO-23, and CO-24 would be treated for the control of mosquito and blackfly larvae.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue an Air Title V renewal for the existing facility located at Massena Energy Facility, Alcoa Power Canal Road, Massena, New York 13662.

The facility is a cogeneration plant consisting of one ABB GT8 gas turbine/HRSG unit with Coen duct burner, steam injection, and Selective Catalytic Reduction (SCR), and one emergency diesel generator. The facility no longer provides steam to a host facility but is a merchant plant furnishing electricity to NYISO grid. Natural Gas is the primary fuel for both the gas turbine and duct burner. No. 2 distillate oil is the backup fuel for the GT. The GT is equipped with steam injection and SCR for NOx control. The duct burner utilizes low NOx burners. This level of control constitutes BACT for this facility. The facility is not subject to PSD, but is subject to the NSPS, Subparts Db and GG. The facility is a major facility subject to the requirements of Title V. The facility's pollutant emissions which contribute to the major source threshold are: Nitrogen Oxides, Carbon Monoxide, VOCs and Nickel. The facility is subject to the CAIR program, Parts 243, 244, and 245.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Project Description:

The applicant proposes to develop and operate a 2.29 acre surface sand mine within a 259.5 acre parcel off of O'Brien Road. The project site is on property owned by Ronald Daggett and lies 1,200 feet southeast of O'Brien Road, approximately 3,700 feet northeast of County Route 47. The mine is intended to operate as a traditional surface extraction of the Grenville Fine Sandy Loam soil type. Mining is not proposed to take place below the local water table. Excavation will be done by mechanical equipment, standard for sand mining operations and for removal of material from a bank face. Mining is proposed to remove approximately 70,000 cubic yards of sand over the estimated 10 year operational life of the mine. Material will generally be mined as unprocessed run-of-bank sand and no processing of material is planned. Final reclamation will restore the site to a haymeadow. Mine areas will be graded and stockpiled topsoil will be spread around the edges, and seeded with a perennial grasses and legume seed mixture. The reviewed life-of-mine area is 2.29 (LOM) acres.
