Project Description:

The Department intends to re-issue the State Pollutant Discharge Elimination System (SPDES) permit that expired due to an oversight in the permit renewal process. Additionally, in accordance with its Environmental Benefit Permit Strategy, the Department has made a tentative determination to modify the State Pollutant Discharge Elimination System (SPDES) permit to increase the flow from 0.600 MGD to 0.850 MGD to account for wet weather flows and the plant's hydraulic capacity. The effluent loadings will remain the same based on the plant's treatment capacity. The existing permitted facility is a secondary treatment plant located at 29 Bulwagga Dr in Port Henry with a design flow discharge of 0.600 MGD of sanitary wastewater to the Lake Champlain, a Class A waterbody. An influent phosphorus sampling & reporting requirement will be added. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information avilable to the Department at this time. As a tentative determination, the Department seeks comments on the proposed modification prior to making a final decision. The draft permit (SPDES # NY-002 2969) is available for review by making an appointment with the contact person listed below.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue modified Title V facility permit to Lehigh Northeast that incorporates compliance with new 6 NYCRR Part 220 NOx RACT requirements. NOx RACT has been proposed as implementation of ammonia injection (SNCR), with a manufacturers guarantee of 50% control, by July 1, 2012. The Blue Haze Plan is being incorporated in to this modification as required by the Order on Consent (R5-20050629-512). Issuance of this permit shall close out the referenced Order on Consent. Part 204 requirements have been expired as they have been replaced by the CAIR rule.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below.
