Project Description:

The applicant requests a renewal of a SPDES Permit to discharge up to 5,550 gallons per day of treated sanitary wastewater to Tributary 33 of Fox Creek, a Class C(t) waterbody, from a primary treatment plant adjacent to the applicant's facility, Scholz-Zwicklbauer Hofbrau Restaurant, located at 141 Warners Lake Road, East Berne, Albany County, New York.

The Department has made a tentative determination to re-issue a permit for a State Pollutant Discharge Elimination System Permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.

A draft permit is available for inspection and comment at the Region 4 office.

Project Description:

Construction of an elevated walkway over a 4.88 acre federally regulated wetland which adjoins Francis and Friars Drive within the Siena College campus. The walkway will provide a means for students to walk from residential facilities to the main portion of the campus. The walkway will be approximately 9 feet wide and approximately 476 feet long. The walkway will result in temporary impacts to 0.2 acre of wetlands associated with the clearing of wetland vegetation and permanent impacts to 61 square feet of wetlands associated with the placement of wood piles.
