Project Description:

This project involves the replacement of 4.7 miles of existing natural gas pipeline in New York and increasing the pipe diameter from 14" to 20". The project will involve the crossing of two DEC Class AA streams: both unnamed tributaries to two City of Port Jervis water supply reservoirs; and it will also involve the crossing of Shingle Kill, a DEC Class C(t) stream, in two places. The total temporary impact to streams will be 0.5 acres. The project will also require the temporary disturbance of 0.4 acres of a DEC wetland.

Project Description:

IBM Corporation has requested the modification of the IBM Sterling Forest facility's SPDES Permit. The existing permit has two outfalls 001 and 002 for the discharge of non-contact cooling water from cooling tower blowdown to Ringwood River and stormwater runoff from Fuel Storage Tank Area and Emergency Generator Pad to a Tributary of Ringwood River respectively. The permittee initiated this modification to correct technical mistakes due to the use of background pollutants (Copper, Zinc, Manganese, Iron, Aluminum, and Sulfide) from Sterling Forest Lake make-up water as basis for the derivation of the permit limits for outfall 001. However, the facility has not used the lake as a water supply source in the past for make-up water for the cooling towers but has relied on water supplied by United Water of New York. Additionally, the discharge from outfall 002 is not to a Tributary of Ringwood River as is presently described in the permit but to groundwater. The outfall 002 designation will be changed to groundwater in the revised permit. The New York State Department of Environmental Conservation (Department) has proposed a draft individual SPDES permit, pursuant to 6 NYCRR Part 750 to reflect the current site operations at the facility. Waste Management of New York, LLC proposes to accept source separated recyclables at a maximum rate of 100 tons per day, at the existing solid waste transfer station located at 264 Old Flatbush Avenue in the Town of Ulster. The facility is currently authorized to accept a maximum combined rate of 350 tons per day of Municipal Solid Waste (MSW), Commercial, and Institutional Solid Waste, and Construction and Demoliton Debris (C&D). The proposed modification to include acceptance of source separated recyclables does not propose any increase in the maximum combined rate of waste to be accepted at the facility.

Project Description:

The applicant proposes approximately .2 acres of disturbance within the 100-foot adjacent area of NYS Freshwater Wetland O-16 (Class 1) for the construction of a residential addition and two car garage on the west side of the existing residence, and filling and re-grading of existing lawn to the south of the existing residence. Approximately 350 cubic yards of fill will be used in the lawn area and 2 new stone retaining walls will bound the yard along the 89 foot and 85 foot contour lines. To prevent further encroachment into the 100-foot adjacent area of NYS Freshwater Wetland O-16, evergreen trees will be planted along the outer retaining wall, and a fence will be installed inside the inner retaining wall. Runoff from the additional impervious surface created by the addition will be collected by a new yard drain with underground infiltration units, discharging outside of the 100-foot adjacent area.

The applicant proposes .33 acres of disturbance to the 100-foot adjacent area of NYS Freshwater Wetland D-16, Class 1 (.95 acres of disturbance total) for the demolition of a single family residence, pool and septic system, and construction of a new house, pool, septic system and rain garden. The proposed house, pool and septic system will be further from NYS Freshwater Wetland D-16 [Class 1] than the existing facilities.

The applicant proposes to establish a 20-foot wide "limited mow zone" with boulders and mitigation plantings along the boundary of NYS Freshwater Wetland D-16 in order to increase the amount of functional 100-foot adjacent area of NYS Freshwater Wetland D-16.

The proposed facilities will result in a .1 acre decrease in impervious surface and stormwater will be managed by a 1,000 square foot rain garden.
