Public Notice

Amendments of the Final Freshwater Wetlands Maps for Erie County:

Subsequent to the promulgation of the final Freshwater Wetlands Maps for Erie County in September 1986, New York State Department of Environmental Conservation (NYS DEC) Staff found an inaccuracy affecting Map 3 of 31. Having investigated this inaccuracy, NYS DEC Staff sent notice of the proposed amendment to the affected landowners and published notice in local newspapers and in the ENB. NYS DEC Staff reviewed public comments received during the comment period and no public hearing was held. Upon review of NYS DEC Staff's findings and recommendations relative to this matter, the Commissioner of NYS DEC was satisfied that NYS DEC Staff appropriately responded to all oral and written comments on the proposed amendment, and that NYS DEC Staff's recommendations were consistent with the requirements of the Freshwater Wetlands Act and supported by the record. The Commissioner ordered that Wetland TE-38, a Class II wetland, be added to Map 3 of 31 for Erie County, effective November 17, 2010. For the purposes of Wetland Map Amendment TE-38, the date of the final agency action shall be the date of publication in the ENB. A copy of the final map and wetland classification sheet has been filed with the office of the clerk of each affected local government and in the NYS DEC - Region 9 Office, Buffalo, NY.

Solid Waste Facility Management Services for Town of Amherst, New York

Pursuant to New York State General Municipal Law, Section 120-w, the Town of Amherst, New York (Erie County, New York), hereby gives notice of the following:

RFP - Lease, Purchase, or License of the Town of Amherst Compost Facility

This Revised Notice to Bidders is to replace the previous version issued on March 2, 2011. Sealed proposals for the above-mentioned project in the Town of Amherst will be received by the Interim Town Engineer in the Engineering Department Building, 1100 North Forest Road, Williamsville, NY 14221 on or before 2:00 p.m. local time on July 18, 2011.

Please be advised that a Proposers Conference is scheduled for Wednesday, April 27, 2011 at 10:00 a.m. at the Administration Building at the Compost Facility, 560 Smith Road, E. Amherst, NY 14051. This will be the only scheduled conference. Proposers interested in submitting comments on the draft RFP and/or proposals are strongly encouraged to attend.

This Draft version of the RFP will be open for comments until 2:00 p.m. on May 27, 2011. Prior to issuing a Final version of the RFP, the Amherst Town Board will review comments received on the Draft, modify the RFP if necessary, and authorize the issuance of a Final RFP. Specifications may be obtained or examined at the Engineering Department of the Town of Amherst between the hours of 8:00 a.m. and 4:00 p.m. from March, 2, 2011 through July 18, 2011, excluding Saturdays, Sundays and Holidays.

Negative Declaration

Niagara County - The Town of Lewiston, as lead agency, has determined that the proposed Town of Lewiston Comprehensive Plan Update and Town of Lewiston Zoning Code Update will not have a significant adverse environmental impact. The action involves the preparation of a Comprehensive Plan Update with the intention of improving the character of the Town. The Comprehensive Plan Update supplements the existing Comprehensive Plan, and this document will be appended to the existing Plan. The update includes information concerning changes in the Town over the past ten (10) years, refines the vision for the Town, and provides new recommendations and adjustments to the Implementation section. The Update also includes a Vision Map which will replace the "Future Land Use Map" in the existing Plan. This Vision map does not represent Zoning but provides the user a general vision of the Town's preferred future Land Use patterns and should be used in concert with the Comprehensive Plan.

The Town of Lewiston Town Board has also prepared a Zoning Code Update to guide development, redevelopment and growth in the Town of Lewiston. The Zoning Code Update focuses on modernizing sections of the Code, but does not change the Zoning map or make major changes to the zoning district text.

The project is located throughout the Town of Lewiston, New York.

Positive Declaration

Erie County - The Tonawanda City Council, as lead agency, has determined that the proposed Spaulding Commerce Park - Roadways, Utilities and Generic Environmental Impact Statement may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves the redevelopment of the former Spaulding Fibre site (Spaulding). The 47 acre site is a former heavy manufacturing facility that ceased operations in 1992. A Remedial Action Plan and RCRA Statement of Basis was issued in 2002. Between 2004 and 2010, the City of Tonawanda, together with the County of Erie, the Erie County Industrial Development Agency and others, undertook the demolition of approximately 860,000 square feet of abandoned industrial buildings, including all known underground structures. The remediation of the entire 47 acre site was accomplished with State and local funding, including the State's Environmental Restoration Program (ERP), which will provide environmental releases to the City of Tonawanda and to end users of the site. The State also completed remediation under the State Superfund for hazardous waste contamination in various areas across the 47 acre parcel. As a result of these activities, the entire site has been remediated to Restricted Residential standards. It has been rough graded and covered with top soil and seeded. The property has been rezoned from heavy industrial to a new zoning district: the Spaulding Commerce Park District (SCPD).

The purpose of the current action is to develop a schematic layout of the site sufficient to construct access roadways and install utility service for the site. A Generic Environmental Impact Statement (GEIS) will also be prepared to assess environmental impacts associated with the future redevelopment of the site. The GEIS will establish mitigations and thresholds to guide future development at the site. It is the intent of the City of Tonawanda to facilitate future redevelopment of the site with the development of the proposed improvements and the GEIS, which will streamline future development approvals of facilities that are in conformance with the GEIS.

The project is located at 310 Wheeler Street in the City of Tonawanda, New York.
