Project Description:
The Department has made a tentative determination to modify the existing discharge permit for the Chenango Heights Subdivision in accordance with the EBPS system. EBPS was designed as a methodology for technical review of SPDES discharge permits. The system is meant to trigger periodic review of prioritized facilities so that SPDES permits may be evaluated and modified, if necessary, to ensure the environmental health of the receiving waters and currency of requirements. The subject modification to the Chenango Heights Subdivision permit is in accordance with prioritized review according to the EBPS.
The modifications to the Chenango Heights Subdivsion permit include: 1) the disinfection period has been changed to May 1 through Oct. 31; 2) a Total Residual Chlorine limit of 2.0 mg/l has been added for the final discharge and the requirement for a chlorine residual to be maintained in the chlorine contact chamber has been deleted; 3) the fecal coliform limit of 2400/100 ml for No. individual sample has been deleted and replaced with a fecal coliform limit of 200/100 ml daily maximum. Additional permit monitoring requirements for Ammonia, Nitrate, Nitrite, Phosphorus and Total Kjeldahl Nitrogen have been included, based on the Chesapeake Bay Watershed nutrient monitoring program requirements. These modifications will protect the water quality of the subject watershed, as well as bring the SPDES permit up to date and in compliance with all applicable laws and regulations. State Environmental Quality Review (SEQR) Determination:
Project is not subject to SEQR because it is a Type II action.

State Historic Preservation Act (SHPA) Determination:
The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management:
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment:
Comments on this project must be submitted in writing to the Contact Person no later than Apr 15, 2011.

Applicant proposes to stabilize 550 feet (total) of the Owego Creek, East and West Branch through a combination of 450 feet of live willow facine and mattress planting and 150 feet of rock rip-rap. The work is at the stream east and west branch confluence north of West Creek Road and State Rt 38 in the Town of Owego.
