Project Description:

The Department has made a tentative determination to issue a permit modification to the Part 360 Solid Waste Management Facility (SWMF) Permit issued to Monroe County for the Mill Seat Landfill, to construct and operate two soil borrow areas to obtain soils for daily cover and operations for the current landfill, and to construct associated roads, berms, and stormwater management. The new 62 acre borrow areas are proposed to be located directly south of the existing landfill, north of Bovee Road, west of Johnson Road, and completely within the landfill property owned by the County. Because the proposed area is onsite, use of public roads for transporting soils will not be required. The west area sedimentation basin outfall structure and discharge will encroach into the 100-foot buffer are of FWW RG-6, therefore an Article 24 permit will be required. The borrow areas will be located in the vicinity of three regulated freshwater westland (RG-5, RG-6, and RG-7), therefore, potential impacts to the westland will be thoroughly evaluated in the context of the draft supplemental environmental impact statement (DSEIS) which was made available by the SEQR lead agency, Monroe County, on February 2, 2011. As a tentative determination, the Department seeks public comments prior to making a final determination. Comments regarding the Part 360 permit and Article 24 freshwater wetland permit requirements, and potential for stream or wetland impacts, and stormwater management, should be directed to the Department. The file, which includes the permit application, borrow area use plan, and the County's DSEIS, is available for review and comment at NYSDEC Region 8 Avon. SEQR comments must be sent to Monroe County. The SEQR comment period, which is separate from the Department's comment period, runs through March 7, 2011.

State Environmental Quality Review (SEQR) Determination:

A draft environmental impact statement has been prepared on this project and is on file.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. The report of the survey is on file. No archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has received an application from the Town of Wolcott for the installation of approximately 8,800 linear feet of 8 inch water main as part of the Port Bay Water District. A portion of this water main is proposed to be installed via directional drilling in the regulated 100 foot adjacent area of NYS regulated freshwater wetland NW-8 on South Maple Street. The proposed project also includes a crossing of a tributary of Port Bay on West Port Bay Road via directional drilling. Standard erosion and sediment controls will be utilized to maintain water quality standards of Port Bay, its tributaries and adjacent wetlands. Town of Wolcott Port Bay Water District is part of an overall joint project being conducted together with the Town of Huron Water District #7. Water supply permitting for this project is covered under the proposed Wayne County Water & Sewer Authority Regional Service Area water supply permit that is concurrently under review with the Department.

The Department has made a tentative determination to approve this application. As a tentative determination, the Department is seeking public comment prior to making a final decision on permit issuance.

Project Description:

The Department has received an application from the Wayne County Water & Sewer Authority (WCWSA) for a water supply permit to establish a regional water supply service area and to use therein a purchased supply of water of up to 7.75 MGD. WCWSA has executed Lease/Management agreements with the Towns of Arcadia, Huron, Lyons, Macedon, Marion, Palmyra, Walworth and Wolcott for the lease and operation of water facilities in these Towns. These agreements do not include the incorporated Villages within the Town boundaries. This permit application proposes to consolidate several existing service areas and to add new towns not previously covered by a service area permit. This application also proposes to include the very northern portion of the Town of Butler, which is a WCWSA owned and operated system serving the Butler Correctional Facility, in the regional service area. Upon issuance of the proposed permit, WCWSA would be permitted to extend water service to customers located in any part of those Wayne County municipalities that have executed lease/management agreements with WCWSA, and are listed in the service area permit, without further Public Water Supply Permits from the Department. No new water main is proposed to be installed at this time.
