Project Description:

This is a Department Initiated Modification of the State Pollutant Discharge Elimination System (SPDES) permit for the Rockland County Sewer District (RCSD) #1 Sewage Treatment Plant. The Department issued a SPDES permit modification on December 10, 2007 based upon a full technical review of the permit under the Department's priority ranking system known as the Environmental Benefit Permit Strategy. The permit is being modified at this time to address permit changes based primarily upon information identified through compliance schedule requirements. The changes to the permit are as follows: Permit Limits, Levels, and Monitoring - Flow: The maximum flow limit of 36.1 MGD has been removed. The permittee requested keeping the 12-Month Rolling Average (MRA) flow limit of 28.9 MGD in the permit. Percent removal: Interim percent removal requirements for CBOD5 and TSS have been revised to 71% and 78%, respectively until January 1, 2013. Mercury: The mercury limit has been reduced from 400 ng/l to 50 ng/l and a mercury minimization program requirement has been added to the permit. Stormwater outfalls: Stormwater outfall information has been added to page 3 of the permit. Whole Effluent Toxicity (WET) testing: Revised to require quarterly chronic toxicity testing during calendar years ending in 0 and 5. The Schedule of Compliance page has been updated to remove the actions that have been completed. NY 003 1895

Project Description:

The Department has tentatively determined to issue Dam Safety and Freshwater Wetland permits, with Section 401 Water Quality Certification, for the rehabilitation of the Browns Reservoir Dam (Earth/Concrete Gravity Dam), located in Lewisboro, Westchester County. Browns Reservoir Dam is a Class B, Intermediate Hazard Dam. Brown Reservoir carries a Waters Index Number (WIN) of Conn. 10-P 1110a and a water quality classification of AA-S. The outlet stream is the West Branch of the Silvermine River, WIN Conn. 10, classified AA-S.

The Scope of Work will consist of:

  • Clearing and grubbing all trees, shrubs, and vegetation on the existing dam and downstream of the Dam to accommodate the new embankment slope.
  • Demolishing the existing gatehouse on the right embankment crest. The existing gatehouse foundation will be extended to the new crest height and slightly expanded.
  • Demolishing the existing valve chamber at the toe of the existing right embankment, extending the existing low-level outlet pipes and constructing a new impact stilling basin downstream of the new embankment toe.
  • Widening the spillway by constructing an additional step at the toe of the drop structure and and approximately 4-foot-thick by 20-foot-wide concrete toe block along the entire length of the spillway.
  • Raising the right embankment dam crest by 4 feet and flattening the downstream slope to 3:1 (H:V). Raising the crest includes raising the existing concrete core wall be approximately 4.5 feet.
  • Raising the left embankment dam crest by 1 foot and raising the existing concrete core wall by approximately 4.5 feet.
  • Extending an existing unpaved access road at the toe of the dam to the full length of both embankments (Access road will traverse NYSDEC Freshwater Wetland D-22, Class I).
  • Construction and installation of ancillary drainage facilities, including culverts, an embankment toe drain, drainpipes, drainage aggregates, geotextile filter/separation fabric, pressure relief valves, drain cleanouts, and related features.
  • Placement of riprap erosion control.

The applicant proposes a new access drive for an existing equestrian farm to replace two existing access drives. Approximately 15,550 square feet of the adjacent area of NYS-regulated freshwater wetland L-2, Class 2, will be disturbed for the access road and associated stormwater quality basin. The 36-foot bridge will completely span the wetland. An additional 3980 square feet of adjacent area will be restored from driveway to a naturally vegetated area.
